Last month, a San Diego woman named Amber Gilles publicly shamed a Starbucks barista for refusing to serve her because she wasn't wearing a face mask.

A GoFundMe campaign raised more than $100,000 in tips for the barista, Lenin Gutierrez.

Now Gilles says she wants half of the money, telling KGTV she was the one who was "discriminated against."

She also said she was medically exempt from wearing a mask, giving the TV station results from a 2015 pelvic exam and a chiropractor's note saying she had "underlying breath conditions."

Wearing a mask is mandatory inside businesses in San Diego County, but there are some exceptions for medical reasons.

Good for her! Double down and go for it as being a bigger count than you already are. I applaud the effort.

He wasn’t being a dick, he was doing his job. I’m tired of everyone taking things out on the employees. They don’t come up with the policy. If he got fired and sat at home collecting unemployment then you would bitch about that.

It's a shame that his company policy includes him being a dick to customers that are trying to buy coffee.

ADA says employers cannot discriminate against employees with illness/disability. Seems a near reasonable attempt to extend or at least demand more definition (as in who's employer? the service worker or just the sick/disabled?)

Yes, it's splitting hairs on verbiage/language but that's what lawyers do.

She tried to tie her inability to wear a mask to ovarian cysts. Her lawsuit is the deadest of dead ends. She needs mental health assistance more than abything based on the details I’ve read.

This has nothing to do with the part of the ADA that covers employment. It's a place of public accommodation.

None. Read the story. It hasn't been filed yet. Hasn't even been drafted. She "wants to sue" the barista and set of a GoFundMe to pay for it because the lawyers were "so expensive."

Basically she couldn't get anyone to take this on contingency fee, as would be the normal arrangement in such a case. Realizing the case is likely a loser, they asked for a retainer, which she is too poor and/or lazy to pay.
