It's a stretch to say you have a brain. The dude walked up to the truck with a gun in his hand, banged on the door, and raised his hand at the driver. Sure, the gun wasn't in the raised hand because he switched hands right before BUT the driver can't see that and had every reason to believe he was raising that gun into his face.
Driver is 100% innocent here.
