Take it back, not signed per se but the officer notes are in the original thread notating each of their statements after they were Mirandized. They admitted to it

anchor this thought for a minute- an intoxicated person cannot give consent.

People are still responsible for their actions even if they are intoxicated.

so if you are drunk and you initiate sex with someone who is clearly impaired, you can be charged with rape.

Ok

An intoxicated male and intoxicated female have sex. Neither forceful, but both have no recollection of the event and we’re completely hammered to the point of not having control

You are the lawyer.

I just know you cant give consent and a woman can take back consent whenever she feels like it. So if Brooks was alive, she can take back her consent even if she wasnt drunk.


It's also why spousal abuse is now not just physical. the feminists won this one.


Maybe some dudes do this, but i wouldnt frick my gf in college if she was black out drunk. because thats not consent.

Carver, IIRC, is the only one who gave any statement to sexual activity and he was a witness not a participant.

The lack of DNA creates a hole that Carver may not be able to fill. I don't think any of the other defendants admitted to sexual contact, but if they have feel free to correct me.

Carvers testimony I believe is the only one of note in which he admitted so her “being drunk drunk”. I don’t recall what he said about the others and their sexual conduct with her

And the way consent laws are currently written in most states, probably including Louisiana, drunk past a certain point means consent isn’t there even if given.

She was three sheets to the wind and they knew it / admitted it, which is why it is considered rape.

I think all of the alleged facts that we know about the sexual encounters were all from his statement.

It's been over 6 months so I may be mis-remembering, so someone can correct me if I'm wrong.
