All this situation does is confirm my reluctant views on not fricking drunk chicks. Sucks but it's better than being accused of rape.

Dude read the LA laws regarding rape and you'll (hopefully) be able to understand why I said 'no'. I've spelled it out in previous posts, but it has to do with defining when sexual acts with an intoxicated person are considered sexual assaults/rapes. There's a certain standard applied that the scenario you proposed would not meet.

I 100% agree. I would never frick a girl I'd just seen throw up. Not even just because I'm concerned it would be rape. Why would you frick a chick so drunk that she's vomiting? That's a terrible idea.

If she drank as much as she said and smoked weed I would think he was in the same condition as she was. Also I don't get how she remembers what she had to drink but not the act.

Yeah if you see a girl vomiting because she's so drunk you should probably know that she's too drunk to have sex.

Most kids in Louisiana have been drinking since 14-15, it's pretty reasonable to think he knew she was incapacitated.

Of course if you are in a state of mind that allows you to notice/deduct this. However, very often, I would say the heavy majority of times, both parties are wasted

Someone correct me if I'm wrong, but the standard in LA for "simple rape" is this:

§43. Third degree rape
A. Third degree rape is a rape committed when the anal, oral, or vaginal sexual intercourse is deemed to be without the lawful consent of a victim because it is committed under any one or more of the following circumstances:
(1) When the victim is incapable of resisting or of understanding the nature of the act by reason of a stupor or abnormal condition of mind produced by an intoxicating agent or any cause and the offender knew or should have known of the victim's incapacity.
(2) When the victim, through unsoundness of mind, is temporarily or permanently incapable of understanding the nature of the act and the offender knew or should have known of the victim's incapacity.
(3) When the victim submits under the belief that the person committing the act is someone known to the victim, other than the offender, and such belief is intentionally induced by any artifice, pretense, or concealment practiced by the offender.
(4) When the offender acts without the consent of the victim.
B. Whoever commits the crime of third degree rape shall be imprisoned at hard labor, without benefit of parole, probation, or suspension of sentence, for not more than twenty-five years.
C. For all purposes, "simple rape" and "third degree rape" mean the offense defined by the provisions of this Section and any reference to the crime of simple rape is the same as a reference to the crime of third degree rape. Any act in violation of the provisions of this Section committed on or after August 1, 2015, shall be referred to as "third degree rape".

So the questions in this case are whether the alleged victim was capable of resisting or understanding the act, and whether the alleged offender knew or should have known of the alleged victim's incapacity.

As I said on page 1, does anyone else find it at all odd that she can clearly recall all aspects that support the rape charge but can't remember anything else?

Remembers the exact type and number of drinks? Hell, I lose count after the third beer. Remembers being sick, remembers her friends, remembers telling him no. Can't remember anything else. Weird. What about the lead up to sex? What was said? Was there any consensual contact? Etc.

If I was the accused, I would counter sue with the exact same claim.



ETA: If I was wasted as well. If sober, then I agree it is a POS move

I have seen people throw up and go right back to partying. I wasn't one of them. Luckily I only got that way a few times.

My problem with the whole scenario is if he was impaired also. We are talking about 2 people who have had sex and were obviously out together(leads me to believe they were on good terms. I would love to know what their relationship was like after the "rape"
