Except I seriously doubt she was "forced" into anything.

A couple of college kids who had been having sex got drunk and had sex again, and now for her own reasons she wants to punish the guy so she claims rape.

How many times have we seen this?

Almost to the point you wanna have the girls sign consent forms and non disclosure agreements. This buyer's remorse crap is unsettling to say to least, women that do that are despicable.

I will say, legit rapes are crimes against humanity, should be prosecuted to the fullest...but girls making false claims make it harder fur the real victims. It's infuriating, really.

Some of these girls can't even touch a guy for years after w/out some PTSD flashback, f ing horrible

If she was black out drunk and vomiting then she was incapacitated and unable to consent. I think in Louisiana law, the standard for "simple rape" is that it's rape if the assailant knew or should have known of the victim's incapacitation and inability to understand or resist the sexual act. If he saw her so drunk that she was vomiting then yeah I think he should have known she was at the point of being unable to consent.

Some of y'all act like you don't think drunk chicks are capable of begging for dick. If you want equality then you can't have a drunk guy wholly responsible but a drunk chick a victim no matter what.

Yeah, if this guy was coherent or not even drunk at all and this chick was vomiting yet he still had sex with her that is rape.

Sorry fr33man but I have to disagree. No guy is having sex blackout drunk, for multiple biological reasons. On the other hand, a girl blackout drunk and immobile can easily be taken advantage of. These are not even remotely comparable from a physical standpoint.

IMO the guy shouldn't be convicted if it's just he said/she said and there's no physical evidence or eyewitness testimony to indicate that the girl is telling the truth while the guy is lying. If all we have are what these two say happened, and their stories remain consistent, then I think you have to just drop the case.

And I use the standard that the Louisiana law spells out--if the alleged assailant knew or should have known that the victim was incapacitated beyond his or her ability to resist or understand the sexual act, then it's a crime.

If that can't be determined (that the alleged assailant knew or should have known) then it may have still been a crime, but there's no way to know.

I've never been able to have sex if I'm shitfaced drunk puking and blacking out. That doesn't mean he wasn't able to, and I'd never convict a guy by making that assumption. But it makes me wonder.

Frankly, I'd need to hear the versions of events as each person remembers them, and find out how consistent those stories stay over repeated interviews. What's published in that article is not enough, so we're left chasing hypotheticals in this thread.

I definitely wouldn't convict the guy based on what was in that article. It's nowhere near enough IMO.
