I agree with you on what she has actually done to this point. However, we can't hold some folks accountable for what they say and not others. What she said just so happens to clash with a university's stated procedures.
At this point, the only thing that really matters is LSU's response. They cannot be seen as allowing individual professors to essentially keep a list of students she doesn't agree with with intent to academically damage them.

The difference between the two is that the kid made a socially unacceptable, yet legal, comment.
The professor threatened to take unconstitutional actions against students that could cause her employer to be sued for large sums of money.
I’m not about cancel culture either, but she should be reprimanded.
She has given every conservative white kid that fails her class legal recourse.
A smart kid would go to her office on day 1 and proclaim his conservative nature and demand an A or else.
