Texas Penal Code Section 9.41 explains that a person is allowed to use force, but not deadly force, to terminate a mere trespass or interference with property.
“Trespass” occurs when a person enters onto or into property, knowing that entry is forbidden or remains on the property after being told to leave by someone with authority.
“Theft” or “Interference with Property” occurs when a person takes another’s property with the intent to deprive them of that property and without the owner’s consent.
Going back to the example above, if you grab your firearm, go outside and fire a shot at the trespasser or someone merely creeping around your yard, you will likely find yourself facing a serious felony . In these circumstances, Texas Law only permits the use of force, not deadly force.

I think it depends on few factors. Is the property in a low crime area neighborhood with a bunch of kids? Is it on rural property where no one is around for miles? Even so, if you are scared, why would you put your self in an even more riskier position by engaging the trespassers outside?
When we were young (80s-90s) we would often sneak out at night to meet up with other kids and sometimes would traverse a neighbors yard or hide in someone's bushes if a car came by in the process. It was dangerous and luckily no one got hurt but a lot of kids did that back then.

Well, obviously I would wait until I heard him jiggle the doorknob but he would have a red dot on his forehead from the moment he entered my fully enclosed fence.

Well, according to moldy_tiger, the only reason it went to trial was because two of the guys played QB for STM and TC. If they were just average public school kids, Seth Fontenot wouldn't have served any time.

If your going to post and critique, you should get the facts right. They were not going to "rob" him, they were on the property to steal some of his chickens. That fact may change some options it may not.
So they were just "stealing" some of his chickens, that the homeowner paid for and the theives *did not* pay for?
How, in ANY sense of the word, is that not robbing someone?
You fricking idiot. It doesn't matter what the value or seriousness of the item is that's being stolen, if someone else pays for it and you trespass on their property to take it - you robbed them. You stole from them. You unlawfully took a possession from them. Period.
However you want to word it, it's theft and it's illegal and something scumbags take part in.
