Sounds like he had to have been bent over at the waist for the bullet to enter his chest and exit his lower back and then through his shoulder to his lung. Possibly leaning into the window.

True and neither do you. You asked how a person would not be allowed to defend themselves in that scenario and I responded. I never claimed that my response was definitely what happened.

True, but the scenario that described at least has some testimonal evidence in support of it.

Right, so anything else is speculation. So to act like one side is wrong and you're right is completely idiotic.

You're acting like you're 100% right while using the same evidence you say isn't enough for anyone else to make a determination.

Those facts alone in no way justify the use of the lethal force in defense.

Right. He has to be reasonable in his belief. If shown that he was a hot head with a history to road rage incidents then maybe just maybe he overreacted because he is unable to control his emotions.

So with the only facts we have now, Gasser looks to be currently guilty of murder, correct?

That doesn't seem as likely as the other scenario. Your instict would be to run after getting shot in the hand, not bend over.

That's not true with castle doctrine Boom. If McKnight was attempting to enter the vehicle unlawfully, you can use deadly force if you think it's the only way to stop the entry. Your post refers to self defense in the traditional sense, not the castle doctrine aspect.

It all changes if they can prove attempted entry of the vehicle by JM. He has the right to prevent the entry by using deadly force.
