You can defend yourself to a real or perceived threat. JM had no business getting out of his car and approaching Gasser.

Also, what I am about to post has no relevance for the trial
The state is going to try to paint him as a hot head who isn't afraid to use violence in road rage arguments. It's certainly relevant.

It will be interesting to see how they spin the window being down. Defense will say it was how McKnight gained unlawful entry to the car. Prosecution will say it shows intent.

It does have a lot to do with the trial. The jury will use it to see whether or not this is someone who was acting reasonably or if this is A man with a track record of not being able to control his emotions.

I am trying to guess what happened, I repeat, I am guessing
I think Gasser should go down for this.

Gasser's case of self defense in the traditional sense isn't very strong, IMO. His attorneys will primarily argue castle doctrine, and rightfully so, as it is his best defense.

Based on what?

Defense better hope they got fingerprints from the window seal. Although the window was likely down because they were yelling at each other the whole time while driving.
I could see a jury being swayed by the 2006 incident though.

Because an unarmed person standing outside your vehicle yelling at you does not constitute an act requiring the use of lethal force in defense.

McKnight had no gun on him, meaning there is no way he showed it. I know he doesnt have to show it, but I dont think he ever once made gasser fear for his life. Standing outside of someones car yelling is in no way is a reasonable fear for your life
Gasser was charged with physically assaulting someone at this exact same intersection before over road rage
I think, based on a guess from the little info we have, gasser killed mcknight out of rage
I could be completely wrong. We will see what more evidence comes out

If I had to bet, I'd say this turns into a Trayvon Martin kind of thing. Legally justified, but the shooter is a worthless piece of shite who started something he couldn't finish and immediately jumped to deadly force.

False

Whether it's correct or not, that's how I see the trial going. Seems the pressure is on the defense to prove this narrative otherwise.

You dont know what happened. Thats your prejudged account of what you think happened. You cant just fill in the blanks with your own thoughts.

I could see that too, but that 2006 incident could be the difference between these cases. The zim didn't have an almost identical situation from his past.

They'll argue his hands were in the car, even if he didn't touch anything yet. This thread is proof the state has an uphill battle. These people think McKnight getting out = justified shooting.

Like I said on page one of this thread, I think forensics will decide this case. They will be able to show where McKnight was and his posture at the time of the shooting. If his blood is inside Gassers car, the prosecution will be in big trouble. McKnight was shot in the hand, shoulder and chest which would seem to indicate he was at least leaning down somewhat since Gassers sedan is a pretty low sitting car. The coroners report will be huge. The witness statements are greatly discounted by the dumb bitch that falsely claimed McKnight was “begging for his life on his knees.” The jury is going to have trouble believing anyone after that shite. The Sheriffs Office 100% should have arrested and charged her.
