That's why I don't think they'll go that route. Hard to prove and it opens them up to the 2006 incident which could be a disaster.

They'll try like hell to prove McKnight tried to enter the car.

Seems like he should have just not been following JM and driving wildly with him for miles then....

there was a 6ft 230lbs angry man at his window that was mad at him, so mad that he got out his car and approached RG car.

Even if he's at the window it's not proof that he was going to attack the guy. Hell, even his fingerprints on the window sill or body of the car wouldn't prove that. The door handle would be another matter.

Agreed

They open up a huge fricking can of worms in the "fear for his life defense" The jury will chew that up and spit it out with his past, plus the mile long ride Gasser had with JM


They will go on he tried to enter Gassers car

It wouldnt prove it, but it sure as hell would help the defense

per my link they were following each other playing cat and mouse weaving in and out of traffic.....I even sent you a link of video footage of JM following Gasser around a corner.

And Gasser was a man with a gun, a man with a gun that physically assaulted someone of road rage before and now started the following of JM.......




They arent going with the fear for your life defense, it would get shredded

So anger is now a reason to shoot someone? Not once, not twice but three times?

And what if the first shot was the one that hit him in his left hand and he bent over from pain? The next two shots are murder. In my opinion.

It could be fear for his life but something needs to come out to show this. If they were chasing each other and harassing each other for miles they were both willing participants.

Obviously they'd ideally like fingerprints on the door handle either inside or out, but they could argue he tried to reach through the window or something. Any fingerprints would help that.

Right but gasser began the pursuit. McKnight cut him off. He could've slowed down and said frick you in his car. He chose to speed up and start this chase and McKnight joined him.

He's gonna get torn to bits if he brings this defense.

It's a peculiar thing about self defense laws in each state. LA doesn't allow the aggressor to claim self defense unless he tried to withdraw:

§21.  Aggressor cannot claim self defense

A person who is the aggressor or who brings on a difficulty cannot claim the right of self-defense unless he withdraws from the conflict in good faith and in such a manner that his adversary knows or should know that he desires to withdraw and discontinue the conflict.

Exactly. They will go with the castle doctrine.

THey are going to stay miles away from trying to make Gasser look like a man that feared for his life in self defense

The mile long cat and mouse chase and past incidents would make that look foolish in the eyes of a jury

JM cuts off RG
RG gets pissed and chases after him.
They swerve in and out cutting each other off and yelling out their windows until they reach the red light.
JM gets out of car, approaches window, and is shot 3 times by RG
