Judge Rules The Mongols M.C. Can Keep Their Patch

A California judge delivered a blow Thursday to a decade-long effort by federal prosecutors to strip the Mongols motorcycle gang of its trademarked logo, ruling such a move would be unconstitutional.
U.S. District Court Judge David O. Carter in Santa Ana nullified a first-of-its-kind jury verdict that would have given the government control of the logo of a Mongol warrior astride a chopper-style motorcycle and two other trademarks.
Ordering forfeiture of the trademarks would violate the First Amendment rights to freedom of association and Eighth Amendment protections against excessive penalties, Carter said.

Good. It's just a bunch of doctors, lawyers and everyday guys wanting to ride around with a bunch of other guys dressed in leather and all wearing the same patch. I don't see a problem with it.

I think it was the State but it was because, they argued, that the patch was used for intimidation and associated with unlawful activity.

Yes, that dude lived a successful but nerve wracking double life. He’s one of the great undercover guys who is in the same highly respected class as Joe Pistone (aka Donnie Brasco) who infiltrated the Bonanno Crime Family of NYC and Jay Dobyns (aka Bird) who infiltrated the Skull Valley, AZ chapter of the Hells Angels.
