Judge reinstated in Madison Brooks rape case

Carver is facing a rape charge for being present in the car in which the victim, Madison Brooks, was allegedly sexually assaulted. Carver is not accused of sexually assaulting Brooks.

Prosecutors allege that Carver and his co-defendants dropped Brooks off along Burbank Drive at her request after the alleged assault. She was later struck by a vehicle and died.

State prosecutors alleged that Ray’s prior knowledge of certain evidence tied to the case would compromise her ability to make unbiased decisions regarding its admissibility.

During the initial recusal hearing, prosecutors also highlighted a text message that seemed to suggest one of Carver’s family members may have had a friendly relationship with the judge.

Judge Myers did not specifically take issue with Ray’s handling of the case, but said public confidence in her handling necessitated her recusal.

It was always an utterly retarded ruling. There was never any legitimate justification for this ruling.

I believe it did lead to new legislation eroding a Defendant's choice in exercising their right to jury trial, though, so there is that.

The legislation doesn't have anything to do with jury trials. It has to do with bench trials, and there is not and never has been a right to a bench trial.

Unfortunately I think enough time has passed and the victim has been demonized enough that the guys will end up walking.

You sound like you know a little about these things. Couple questions if ya don't mind.
Can a defendant waive jury trial for a bench trial?
Does it depend on the crime?
Does DA have to agree?

it's going to be very difficult to prove rape beyond a reasonable doubt
no one knows what all is on the phones during the event
Carver probably won't see life in prison for what happened, my guess would be 5 max if that

now do they get any negligence in her death side of it, possibly, but even that would be minimal prison time

Lawyers have not bled all of the available money out of it yet.

Perhaps when they get off scot-free more white girls will realize the stupidity of getting in a car with multiple black guys. After this they will be legally free to do whatever the frick they want to do to you in Louisiana.

Who is to say that Carver won't testify against Lee and Washington as an eye witness to the case that both tPOS raped her for a lenient sentence?

A defendant can waive a jury. Once he does, it is irrevocable and he's stuck with bench. Doesn't matter the crime. DA does not have to agree. There was a push this last session to make that a thing. However, now if a defendant waives a jury, the DA can require that the case be re-allotted to a new judge. Once the defendant gets that new judge, he's still stuck and cannot decide to go back to jury.
