absolutely, recusal is its own separate animal. But if successful you're still stuck with whatever judge you get.

Interesting. That’s a good compromise that stays within constitutional bounds

Wait two of the guys that were in the car have sued the mom of the dead girl for defamation?

Ain't it funny how when tLSU knocked SFPs dick in the dirt the he abandons the thread without even a hint of "my bad" or "I stand corrected", and the thread kinda dies.
Could SFP be a paid contrarian tasked with shite stirring to get reactions and increase traffic???
Chicken? If that a-hole is on your payroll I'll lose all respect for you.

there is not...a right to a bench trial.
False.
Louisiana Laws - Louisiana State Legislature
Art. 780. Right to waive trial by jury
A. A defendant charged with an offense other than one punishable by death may knowingly and intelligently waive a trial by jury and elect to be tried by the judge.
B. The defendant shall exercise his right to waive trial by jury in accordance with Article I, Section 17 of the Constitution of Louisiana. The waiver shall be by written motion filed in the district court not later than forty-five days prior to the date the case is set for trial. The motion shall be signed by the defendant and shall also be signed by defendant's counsel unless the defendant has waived his right to counsel.

It was always an utterly retarded ruling. There was never any legitimate justification for this ruling.
I’m no lawyer but I thought it was a conflict of interest to have a judge who’s son has been convicted of rape & similar charges presiding over a case regarding rape

Geesh!
I thought this would have already been over.

Not to derail the thread but just checking in for a SFP sighting.
Nada.
The dude who is the greatest litigator in Calcasieu Parish, with one of the highest post counts in TD history, suddenly seems to be absent.
So weird right?
What a dipshit.

The legislation doesn't have anything to do with jury trials. It has to do with bench trials,
I said "exercising their right to jury trials"
The wording was intentional
The legislature has decided to permit the state a role in what should be an exclusive decision of an individual.

Who is to say that Carver won't testify against Lee and Washington as an eye witness to the case that both tPOS raped her for a lenient sentence?
That ship sailed when the added video voyeurism charges to him, late in the process, I reckon.

No I just forgot about the thread until just now. Good try, though.

When they changed the law a few years back to this alone it was an incredible erosion of our rights, and they just tripled down on that erosion with this new law.

Not really sure how. It's just a notice requirement.

The board is split on that opinion.. Probably same as a jury would be.

Wasn’t he the driver? So the implication is that it’s his vehicle… therefore he bears responsibility for what he allowed to occur in it and who he picked up

Trial for man accused in Madison Brooks rape case reset for November.
A bench trial for Casen Carver, one of the men accused of raping LSU student Madison Brooks, has been reset for Nov. 16, a judge ruled Monday.
Carver’s bench trial had been scheduled to begin Aug. 3 before Judge Fred Crifasi, but that date has been removed from the calendar. After months of legal disputes over which judge would preside, the case remains with Judge Gail Ray.
Just last week, the Louisiana Supreme Court denied prosecutors’ request for a rehearing after they sought to have Judge Ray removed from the case. Prosecutors argued she may not be impartial because she previously heard evidence during pretrial proceedings. They also cited messages they said were sent by Carver’s father claiming Judge Ray would rule in his son’s favor.
The state’s request was denied, and Judge Ray will continue to preside over the case.
