absolutely, recusal is its own separate animal. But if successful you're still stuck with whatever judge you get.

Ain't it funny how when tLSU knocked SFPs dick in the dirt the he abandons the thread without even a hint of "my bad" or "I stand corrected", and the thread kinda dies.

Could SFP be a paid contrarian tasked with shite stirring to get reactions and increase traffic???

Louisiana Laws - Louisiana State Legislature
Art. 780.  Right to waive trial by jury

A.  A defendant charged with an offense other than one punishable by death may knowingly and intelligently waive a trial by jury and elect to be tried by the judge.

B.  The defendant shall exercise his right to waive trial by jury in accordance with Article I, Section 17 of the Constitution of Louisiana. The waiver shall be by written motion filed in the district court not later than forty-five days prior to the date the case is set for trial.  The motion shall be signed by the defendant and shall also be signed by defendant's counsel unless the defendant has waived his right to counsel.

When they changed the law a few years back to this alone it was an incredible erosion of our rights, and they just tripled down on that erosion with this new law.

Wasn’t he the driver? So the implication is that it’s his vehicle… therefore he bears responsibility for what he allowed to occur in it and who he picked up

Trial for man accused in Madison Brooks rape case reset for November.

A bench trial for Casen Carver, one of the men accused of raping LSU student Madison Brooks, has been reset for Nov. 16, a judge ruled Monday.

Carver’s bench trial had been scheduled to begin Aug. 3 before Judge Fred Crifasi, but that date has been removed from the calendar. After months of legal disputes over which judge would preside, the case remains with Judge Gail Ray.

Just last week, the Louisiana Supreme Court denied prosecutors’ request for a rehearing after they sought to have Judge Ray removed from the case. Prosecutors argued she may not be impartial because she previously heard evidence during pretrial proceedings. They also cited messages they said were sent by Carver’s father claiming Judge Ray would rule in his son’s favor.

The state’s request was denied, and Judge Ray will continue to preside over the case.
