If the expenses are CLEARLY, and I mean CLEARLY marked personal... that may be enough to remove the fraudulent intent idea.
In my opinion he is still guilty because he should have known what he was signing and that the income reported was too low.
But... if it was all marked personal.... and if he never actually talked to the guy... and if he signed the returns at the last minute... etc...
The "I'm a dumbass who didn't read what I was signing" defense MAY be enough to get him off.
If I had to guess... 80 percent of my clients don't review their tax returns before signing. Especially if they don't owe a lot of money.
