Would you want to stay at a job where they would randomly check to see if you had had any drinks in the the last month?
Why does your work have a right to say how you enjoy YOUR hours.
It’s about the stupidity of saying “hey, you did something on your own time 2 weeks ago on your vacation. Now you’re fired,”
It’s fricked up. If you cause an accident, sure. But if you weren’t under the influence, why the extra stress?

Key point there was During working hours
When the drug screen for your employee comes back the lawyer suing you is going to have a field day.
That is what companies care about. Not that you get high, they care that you expose them to more risk.

I don’t really see the need for random drug tests. I don’t give a damned if you’re shooting up heroin in a bathroom stall as long as you’re a rock star during working hours.
An employee that operates a motor vehicle and gets in an accident with drugs in their system opens your company up to huge to liability issues in court.
I'm guessing you aren't a business owner?

Not in the traditional way, but the end results are all the same.
Should be allowed regardless.
Eta- to clarify, I’m not trying to say weed snd cocaine are all the same, simply that you can be addicted to weed. We can play semantics about what qualifies as addiction.

Tell that to DOT.
This, it isn't company policy, it's DOT policy to do randoms.
It's a blind draw, and they do like 1 or 2 a month. And some companies will kind of pick the same 4-6 people who don't smoke.
But that Smoke was 2 strong and he bailed.

He would of been in distribution business, delivering product to grocery stores. Not hard, and the money + benefits are really nice. He's still in same field, but sticking with $16 n hour to smoke the refer
I have a sales position, and literally got him thru the front door. He was having a 1 on 1 convo with district manager, to finalize hiring Tuesday, and texted me hour ago with the news. LOL

Most have the common sense not to get too worked up over pot. Especially with all the CBD products out there now. Just make you do some silly counseling or something like that.

What part of during working hours are you people missing? Don’t be using anything until you’re off.
And yes, I have ownership interest in a few business entities; However, none include delivery services.

Is $5-$7 more per hour (plus benefits) that strong of an incentive to quit doing something he enjoys for a position he’d be terminated from if he slips up and fails a drug test?

They way this is worded makes it appear that there are random piss tests, but not one to get hired.
How was it about to be finalized without testing his piss in the first place?

that isn't how DOT testing for marijuana is done. what part are you missing that the OP's company is following the law and not a company policy?

If he gets in an accident at the place he works now, does drug test(insurance mandated), it will be same situation, and now with nothing.
At least if he got popped down the road, he would have a CDL B(air brake), paid for by the company before he got fired.
He gets fired where he's at, he still has derelict class E license. At least he'd have the cdl B to find another good paying gig. He gets fired from other gig, he'll be begging to work at amazon to pay the bills.

Yes, I know several who just stay with an average or less than average paying job to continue to partake instead.

He probably wouldn’t have it or at least get it suspended after your company reported the failed test.
