That's awful generous.
Once they fall behind it gets harder and harder to catch up. Just had to get the constables to put someone out who we've gotten eviction judgements on for 6 straight months.

Thanks for all the feedback. We know that we have been more than nice about this. We don't need the rental money to stay afloat we just use this extra as our little oil well so to speak. The lady takes very good care of the property doesn't seem to live beyond her means, non smoker no pets etc Which makes our lives easier in that aspect. Unfortunately her nonpayment this time is apart of a written agreement we had that she came up with.

You cant be a nice guy and be in the rental business. You'll get taken advantage of every time.

To me, this is key. You are describing someone who - despite seeming to be in a tough situation - is trying to do the right things.
You seem to be a good person who has been willing to accommodate her and her daughter and bend the rules a bit.

Life is mostly a big grey area with small slices of black and white. Yes, there may be a written agreement, but that doesn't necessarily mean you have to enforce it without regard for her personal situation. Act based on the person, not the document.
In the end, it's obviously your property and your decision. But continue to think on it and try not to let "the letter of the law" play too big of a role. Yes, those documents exist for a reason, but I doubt she's going to go around telling deadbeat friends to move into this property she just moved out of because the landlord is a pushover.

I am a long term landlord. I currently have a tenant that has been with me about 10 years.
She too is a single mom raising two daughters. And I have likely never raised her rent.
She hardly ever calls and breaks her payments down to the 1 and 15. But they come in on the 15 and 30.
She knows that those are my limits and abides by them for the most part. Otherwise, I get nasty.
I think with you more than the money, it is the annoyance of being late consistently.
At one point she lost her business and was in dire straights. I forgave a months rent in order for her to catch up. She has always remembered that.
I do run a business and have evicted a testy tenant who was always two weeks late. Her attitude got her to the curb.
If I were you, considering all you've stated (5 years, not extravagant, takes care of the place) I would think about wiping the slate clean, with the understanding that if it happens again she will have to go.
It's a business, but it's a people business too.

My tenants were a pain in the arse with partial and late payments for three years. When I had enough and decided not to renew their lease, they rewarded me by leaving behind thousands of dollars worth of damage. I can't squeeze blood out of a rock, so it's money I will never see back.

That's a tough call. Where is this????? If it's in the BR area I would have a problem evicting them, just because there is nothing available. But you still have an agreement with her and she needs to get it fixed.

You've also had 60 months of continuous occupancy and 60 months without any cleaning, painting or remodeling expenses so you're way ahead of the game compared to most landlords. I'd do everything I could to hold on to a tenant like that.

I didnt read the whole thread, but yea thats tough. its hard to find good renters and if she's been there a long time and has been pretty good, you might try to work with her. Also if you can afford to. But if you're paying a note on the house, you can only do so much. as the guy who manages my rentals always says: "Either my kids get to eat or theirs do."

2) If you feel bad about it, just go over to her home and speak with her. Try to work something out that she pays just a bit extra each pay period for her to get her caught up. So, offer up some help for her.

4) Do you have a good lawyer? If you have been taking partial payments from her for this long, you're going to need a good lawyer if you just up and evict her and put her on the street.
