i suspect you will not be held legally liable if you spend it. You could easily not know it was there and "overdraw" on it. but, that doesn't mean i expect you'd be off the hook for paying it back.

The IRS always come for what's owed. Just because you have it, does not mean that you are legally entitled to it. The IRS can easily say that you should know what the return would be based on your tax filings. I would definitely contact the IRS or a CPA. They may charge interest on it if you wait too long. Worst case scenario - you get a tax lien on your house.

This is your answer. Do NOT play games with them because they will not be playing around with you when it's time for repayment. Contact them via phone (not as hard as some make it sound) and get it resolved.

You should try to give it back. The first issue is that you know it was erroneously deposited. The second is that you posted your knowledge on a public website. Third is that you know it should be returned.

Now try to return it or you will likely be considered to have knowingly taken it.

See what I did, I went to irs.gov - and they had a search box. In that, I typed contact. Up popped telephone and local assistance.

You'd call the IRS. They can and will charge you interest on it, so I'd do it sooner than later.

Good luck. I’ve been having issues with one of my tax payments. Called the help line on the form sent by the IRS. The number was disconnected. Good ol federal government.
