You aren’t giving us an entire story and if he issued a policy without a lapse and everything was processed, then you aren’t detailing very well what the frick happened

I’m thinking he waited too long between cancelling one policy and having another issued and you had a small lapse. Hence you still paying insurance for the last two years.

If you cancel insurance (assuming this in Louisiana) your company automatically reports the cancellation. If the vehicle is still registered it’s flagged as not having insurance.

I skimmed the thread so if this was answered or I’m misunderstanding the timeline please let me know.

It wouldn’t happen that way. If anything coverage would overlap. It is most likely a transmittal delay or error between the carrier and the dmv that is easily fixed

Sounds like the policy that was originally in force was cancelled prematurely or the new policy wasn’t issued when it was supposed to have been and he got hit with a lapse.

That’s an assumption based on very little detail from the OP. It’s just as likely there wasn’t actually a lapse. I deal with it all the time with the FL DMV

Does Florida require you to carry and do they have a no pay no play type law?

Yes, carriers electronically report to the DMV daily and you will get a license suspension without insurance. I have people failing to turn tags in all the time but will cancel the insurance and then wonder why they got a pending suspension letter.

Unfortunately our state minimums are shite compared to LA, which is hard to believe

LA is already too low at 15/30/25. How low is FL’s minimum limits?

Florida does not require BI as part of their minimum limits. For their minimums they have $10k in PIP and $10K in property damage.

California has low limits. 15/30/5. But if you are low income you can get a policy that only has $3k worth of property damage coverage.

Correct. We also don’t have Uninsured motorist coverage for property damage, only BI

We have people driving around with no bodily injury liability coverage and 10k of property damage

This was huge in Louisiana a few years back (2016 maybe?). They were hitting people that sold cars 10 years before and never turned in their plates and said they were driving vehicles without insurance. It was a mess.

Thankfully you can now cancel your Louisiana plate online.

E and O is common, sue him for negligence and his E and O carrier will pick up his defense and likely settle. Very common. You have a negligence cause of action.

My posts over time will show I agree with you generally and hate what has happened in personal injury and property damage claims. However, this seemed like an agent error.
