I’m being sued by a former employee

Long story short, a manager of mine was harassing an employee by calling him a gift from god while mocking his religion. When I was made aware, I fired him instantly.

The fired manager is now suing me and our family business for wrongful termination

Yes, we have documentation including write ups for corrective behavior signed by him.

You should berate him in front of the judge, they like that.

I’m in NC which is an “at will” state as well, but I’m told by our attorneys that the laws around termination can get murky.

Thank god for our documentation. Document everything, baws.

I just can’t believe this guy was employed with us for so long and it took as long as it did to get to my desk.

ETA:

Almost embarrassed that we hired and trusted someone who thinks this kind of behavior is appropriate and acceptable

I mean, this is the kind of shite that everyone understands ruins careers, right?

If you are in an at-will state and the employee is not represented by a bargaining unit, either of you can sever the relationship any time you want.

Now if the employee in a member of a protected class, that is another story all together.

If he is being represented by an attorney and that attorney is taking it on contingency, then its going to cost you something. No attorney is going to take a case unless he sees himself getting something out of it. Your best bet is to settle now, which is probably what your former employee and his attorney are looking for.

You are completely correct unfortunately. I hope the OP has EPLI coverage. The average cost to defend these cases is $30,000 and that is even if you are found innocent. Most policies cover something like $10k for small businesses but that is absolutely nothing. OP needs to be prepared to pay a lot to fight or pay a little less than a lot for him to go away if there is no insurance.

An employer can fire you at any time without cause
