Do you have an employee handbook that states a no tolerance on that, in which the manager signed?

this works both ways. Major companies have poured millions into ad campaigns blasting any law suit as frivolous to dissuade anyone from suing through shaming.

The Mcdonald's coffee burning incident was a prime example. That was a legit problem that gave a woman Third degree burns an left her going back to the hospital for 6 months to get skin grafts. But because of ad campaigns only thing people remember is somebody trying to get rich off of mildly hot coffee. Which absolutely wasn't the case.

Point being a lot of people are shitty, a lot of companies are shitty, and sometimes it's hard to see which is more shitty

I think you’re giving attorneys practicing full time in a town of less than 2000 people just a little too much credit.

I’m not sure they’re aware of the internet outside of Facebook.

I think you did the right thing by publicly posting about a pending court case on a blog. Smh

Hope you have a good Employment Practices Liability Insurance policy. Unfortunately, all business owners need one now.

If we knew the demographics of each player in this case, it would help.

That makes ALL the difference. Trust me.

If you have all that and are based in a right to work state you should be ok.

Right-to-work-laws say workers can be fired for any reason. A common misperception is that, like my reader's question says, they mean an employer can fire employees for any reason or no reason at all. ... At-will means your employer can fire you for any reason or no reason at all.

We do.

My attorneys seem to be very confident and are still conducting interviews, etc.

doesn't mean there won't be repercussions, unfortunately, these days an employer must strategically plan the termination of an undesirable employee

But even that can be challenged, given the right circumstances.

It's the same as saying you can absolutely walk out into a road of busy traffic. You might get run over, but you can do it.

they all are, until they find out what judge they'll be presenting to, judge/jury always the weak link

here here, unless your in Tejas, and their business friendly kangaroo courts, you are at the mercy of a retard judge or retarded jury, if it goes that far, + your lawyer costs.

It's Never a joke if your being sued, especially if you actually have something to lose.

This has nothing to do with the firing being justified. OP is either going to pay his attorney big bucks to defend a frivolous lawsuit or a smaller amount for the former employee to go away. His choice.

If he wins in court, can't the judge require the former employee to pay for the OPs legal fees for the bullshite lawsuit?
