I'm in a heated custody battle with the smoking gun being I drink beer around my children and yet, you've managed to make your life seem more miserable than mine at the moment. I'm not sure if I should congratulate you or give you a shotgun.

isn't there a guide using your weight and number of drinks to rough up what your blood alcohol content is? If your a big baw then 2 beers may keep you below .08.

Why doesn't your ex say you have sleep apnea and that actually hinders your driving more that being .08. Wouldn't most people who take a sleep apnea test show a slight bit of sleep apnea? Ex should order you to have a sleep apnea test before kids ride in car with you.

You should have a reality show called American Drunk. 7 beers a week is not normal. If you and your new wife both had two beers at dinner and either of you drove home, you where driving under the influence. I hope you did not have your kids with you.

You keep acting like this is a criminal trial. It is not, it is a civil trial. The burden of proof is preponderance of the evidence, not beyond a reasonable doubt. Add to that , it's family court, which means it's not a civil jury but a judge who has even wider latitude with how he weights the actual details of the evidence vs what he believes the evidence indicates.
You've been given some good advice pertaining to how you should behave going forward, follow it. Also, in terms of your lawyer, if he argued that you were not overly indulging in alcohol with your 2 drinks with dinner, there is little else he can do. If you kids are saying "daddy drinks beer all the time when we are at his house" that also will weigh on the judges decision, so keep that in mind. And the kids do not have to say that in open court or even with your lawyer present in most places now, it can be a private interview with the judge or a social worker.
If your ex is being spiteful and using the kids as pawns in a game of revenge, then I hope you ultimately get full custody of your kids, If you actually have an alcohol issue, I hope this episode drives you to examine your life and habits and come out the other end of this a better man and better person.
In whatever happens, I hope you and your kids end up in each others lives in a meaningful and positive manner. It is important for you but even more so for your kids. They need to have a solid dependable father figure in their life and their actual father is the best person to do that. It would be ideal if you and their mom could put the past hurts behind you and at least be cordial to each other for your kids sake.

My ex? My lawyer was a woman as is my ex, that was 27 years ago, we had joint custody of the kids and I was domiciliary parent. I'm guessing you wanted to reply to the OP?

Go to the Avvo profile of the firm I recommended. 28 reviews and not one negative. In this business, it says a lot when 28 former clients take the time to fill out a positive review for their lawyer.
