State is going to have an extremely tough case here. I mean the arrest report even says the deceased swung first. I would imagine their goal is to hope he takes a plea bargain for a lesser charge out of fear of going to trial

Honestly, I wonder how repath’s family feels about the perp if it really is true that the deceased swung first… I don’t believe he was trying to kill him

I agree. I just think that nobody in either party set out to kill someone. Intent does matter right? It was just a bar fight

He is being charged with manslaughter so even the state isn’t arguing his intent was to kill

I admit to not knowing jack shite about LA crim law but I imagine the phrases walking backward and hot pursuit were used in the police report to break the chain for self-defense or defense of others. The case is going to revolve around witnesses and any video available and certainly a detailed understanding of LA homicide laws.

The aggressor cannot claim self defense though. Seems like Marsiglia and his crew were pursuing Repath. Repath swings on them and Marsiglia knocks him to the ground, where he hits his skull and dies. Gonna be a tough self defense claim.
