According to a police report, Repath and his group were involved in an altercation inside the bar just after 1 a.m. Police said Repath was walking backward out of the bar when Marsiglia and his friends were in "hot pursuit." The document said Repath swung at one of the members in the group. He missed and they hit back, knocking Repath backward.
And an actual lsu college student is the one arrested while the one not in college is the one who died. Kinda flips this thread on its head and everyone wanting to ban non lsu students

let's have a mostly peaceful March for Marsiglia
Posted on 4/3/24 at 8:49 pm to Lester Earl
State is going to have an extremely tough case here. I mean the arrest report even says the deceased swung first. I would imagine their goal is to hope he takes a plea bargain for a lesser charge out of fear of going to trial
Good luck Hillar

Investigators believe Marsiglia punched Devin Repath one time while in the parking lot of Fred’s Bar & Grill on March 23, 2024. However, Repath is accused of punching Marsiglia or someone in his group of friend

The most common defenses for manslaughter in Louisiana assert that the homicide was justifiable and therefore not a crime. Louisiana law dictates that a person could be justified in killing another in several circumstances, including:
An act of self-defense against great bodily harm
Preventing a person from committing a violent felony against you or others
Good luck Hillar

Honestly, I wonder how repath’s family feels about the perp if it really is true that the deceased swung first… I don’t believe he was trying to kill him
Posted on 4/3/24 at 9:04 pm to TheRouxGuru
One punch completely ruins/alters two lives and all of their families as well
So sad and pathetic on both parties ends from what is sounds like

I agree. I just think that nobody in either party set out to kill someone. Intent does matter right? It was just a bar fight
Posted on 4/3/24 at 9:06 pm to TheRouxGuru
He is being charged with manslaughter so even the state isn’t arguing his intent was to kill

I admit to not knowing jack shite about LA crim law but I imagine the phrases walking backward and hot pursuit were used in the police report to break the chain for self-defense or defense of others. The case is going to revolve around witnesses and any video available and certainly a detailed understanding of LA homicide laws.

lsupride87 and TheRouxGuru are the resident attorneys and they will solve this case.
I’m interested to see how this plays out.

The aggressor cannot claim self defense though. Seems like Marsiglia and his crew were pursuing Repath. Repath swings on them and Marsiglia knocks him to the ground, where he hits his skull and dies. Gonna be a tough self defense claim.
