Juries are always a crapshoot. I have a very very hard time seeing a jury in Louisiana convicting someone in a one punch scenario where they didn’t swing first

Seems like Marsiglia and his crew were pursuing Repath.

The answer is yes either way, but still you’d assume the police report is based on witness statements or other evidence so kinda in line with the facts and potential testimony.
Aggressor, time and space elements of fight and break in fighting, self defense issues.
Sounds like MM either was initially or became the aggressor. Repath swinging because he’s being attacked shouldn’t change that.

30 years ago was at Murphys and a huge frat fight broke out right outside the entrance. I was walking up and 4 dudes jumped me. I swung at tge first guy I could reach because I knew it was my only shot at getting one. I took about 10 shots but knocked the first guy to the ground.
First swings aren’t always what they seem.

The reporting suggests Repath threw the first punch both inside and outside the bar. The issue will probably boil down to the "hot pursuit" and if that flips the aggressor.
Anyone know if "hot pursuit" is a term of art in LA criminal law with regard to assault and battery/homicide?

It’s just in general a fight where the guy is punched once and dies will be a naturally hard case
Not a blindside sucker punch, not a stomping on someone knocked out, etc. I just mean the general nature of the case to convince a jury seems tough
Also, there is only mention of repath and the other group for now. No mention of his friends. That seems somewhat odd

Neither the deceased or accused were/are awful people. They put themselves into a bad situation while drinking which most of the time ends up harmless in the grand outlook of life
But it ended tragically here
