Based on those facts I would say she absolutely had control over his actions

how does she have control over his actions?

there was no threat, duress, coercion, etc

his actions were his own.

aren't there medically proven, accepted facts regarding chemical imbalances, for example, with addicts and/or people with mental issues, and the entire premise is they can't simple control their own decisions like the rest of us?

let me know when that defense works when an alcoholic kills somebody while driving drunk

I'm pretty sure there was coercion.

Jim Jones comes to mind here.

Telly Hankton is facing a death sentence for telling friends of his he needed witnesses dead. Nothing more than words. Didn't give them the guns, didn't pay them, wasn't anywhere around when the murder happened, just used words.
is this true?

Never heard of this story, but would throw a wrinkle into a lot of folks' theories in this thread.

Conspiracy to commit murder is a well known crime

I'm unaware of conspiracy to suicide in the common or civil law tradition however

Of course, actively helping someone kill themselves just falls under murder/manslaughter whatever.

In fact, Kevorkian only got jailed when he was proven to be physically present at one of his patient's suicides IIRC. Before that he merely advised them on how best to do it.

Line was busy? This didn't occur in 1985. Good thing you are not the defense.

Seems like an extremely dubious charge.

whether anyone believe in the law or not...assisted suicide is illegal in most states here.

And it's pretty clear she assisted.

One (of the many) basic requirements for physician assisted suicide to take place without the physician being charged is that the person has to be of sound mind when making the decision.

That's a crime? Guess I better stop telling people to kill themselves for saying something stupid online.

I wouldn't do it regardless. However,

Not the same when you are communicating with people online under completely different circumstances.

The thing is..

This was planned and continued to be consulted about among trusting friends. It was not a spur of the moment reactionary communication. She had numerous opportunities to do something about it and she chose to continue encouraging it. It's extremely sick.. even when he was hesitant during the event itself she said, "Get back in" She had an opportunity even at that very moment to seek help, or steer him another direction. She should be accountable in some capacity.

Im kind of twisted about this. ?the girl is a pos. He was confiding in her. He was in a very weak state of mind. She had power over him in a way. She could have helped him. But she didn't, she in a way pushed him over the edge.

But then again, what kind of precedent does this set. I had a friend in high school who battled depression. Every week shed call me crying, and I'm calming her down. One day I got sick of it and said you know what I no longer care. If you want to cut yourself go right ahead just leave me out of it... am I responsible?

Or another case, I was joking wit a friend and told him to go jump off a bridge.. so if he actually jumped off a bridge, would I be responsible?

My initial suspicions were, and still are, that this girl was looking to pad her resume for college applications. She wanted to be able to talk about how she organized a benefit for suicide victims, etc.

Could be wrong...
