40% plus expenses if a case is filed in a court.

Doesn't have to go to trial.

Not in my case. Original medical bills were $91k. Humana only placed a lien of $25k. Negotiations dropped it to $12k. That difference of $13k went to me.

Usually 1/3 for settlement and 40% if it goes to trial.

40% is probably the average. My office does 35% if it settles pre-suit filed, 40% after. 45% if appealed.

My attorney charged me 40% of settlement funds because he filed suit. It would have been 33% if settled before case was filed in court.

Also settled after 4 years of going nowhere.

This can all be solved with loser pays. Low-life bitches hiring Gordon would have to pay the other parties cost. Problem is most of our lawmakers are scumbag fricking lawyers. Why we need amendments that prohibit lawyers from serving public office. In case you didn't know, I hate fricking ambulance chasers and even worse, my insurance company settled with them even though the plantif couldn't even prove he was at the fricking accident. If there's a hell, Gordon and Morgan are headed there.

Insurance companies killed these proposals. They loose most of their defense cases, and the delays save them big time from reducing payouts to investing reserves.

Newt Gingrich had to take it out of the ‘Contract with America’ because the big insurers said ‘no.’ It’s all a money grab.

It’s completely negotiable, if it’s a big case with high odds to win, they’ll take a much lower percent than 33. Everything about it is negotiable

This is false. Attorney gets contractual percentage. If there is a reduction, that absolutely goes to the client. (And now you are better to get the insurer agree to let you do that, as technically the insurance company would be entitled to the benefit...which is wrong imo.) Standard fee is 33% prior to suit filing, and 40% after that.

The plus expenses part pisses me. If its % base then it should include expenses. Otherwise it should be time and materials contract.

Maybe this is why I will never make a lot of money. I couldn't imagine exploiting someone like that. I couldn't sleep.

I also couldn't sleep taking 30% of their money.

Expenses include cost of filing in court, postage, copies, expert witnesses, travel.
