Hard Rock Hotel developer sues New Orleans over height limit, politics

The developers of the ill-fated Hard Rock Hotel have sued the city over a new measure that would restrict the height of future construction at the site of the building collapse, alleging that it’s a politically motivated ploy from City Council member Kristin Gisleson Palmer.
The developers say that lowering the maximum building height allowed at the site from 190 feet to 70 feet constitutes an illegal taking of their property, and they’re asking an Orleans Parish Civil District Court judge to declare a motion sponsored by Palmer null and void.
quote:
But the group claims to have Hard Rock International, the Florida-based hotel and casino firm that licensed its name to the original project, back on board for another venture.
This time around, the project will feature new contractors and “world-renowned” engineers, the developers say.
quote:
The City Council voted unanimously June 3 to ask city officials to draft an ordinance rescinding the conditional use permit that allowed the Hard Rock to rise to 18 stories. The council must approve that ordinance before it goes into effect. A vote has not yet been scheduled.
quote:
For Palmer, the building collapse was the result of untrammeled greed, and she unveiled her motion limiting the height of future development with a broadside against the Kailas group.
quote:
The exact cause of the collapse has yet to be determined, but the developers note that an interim report from the federal Occupational Safety and Health Administration cited the project’s lead engineer, James Heaslip, for dire safety lapses.
It’s the engineer, project contractors and the slipshod city Department of Public Safety and Permits that should bear the blame, the developers say.

Uh id say it was shitty construction and corrupt city inspectors

Would this be considered Phase Ta-two of the project?

The developer acting like they have zero culpability in this is pretty fricking hilarious. They hired the engineers and contractors, I'm sure at the lowest cost possible. Just as I'm sure they cut every corner they could on the design in an effort to save every last cent. This guy can kick rocks.

Who hired them?

Rescinding a conditional use permit after a building collapse seems reasonable.

as someone who deals with this for a living...frickING THIS - but it's the bullshite cheap arse developers that hired the engineers and contractors and drove them to VE the structure below safe allowable design.
but Nola is gonna Nola, despite any logic, evidence, common sense, etc...

I didn't see any mention of who they hired to write this frivolous load of shite. Anyone know who the Kailas attorney is?

I'm all for height limits in the french quarter. What has happened to Canal is a travesty. It used to be a high end shopping district. Now it's one of the worst parts of New Orleans downtown. Outside of Rubenstein's it's soulless and tacky.

That has more to do with the kinds of stores and restaurants that line canal rather than the architecture of the buildings they are in. Other than the first couple blocks from the river, the buildings are all still classic style buildings. They’re just filled with crappy t-shirt shops, liquor stores, and seedy quick service restaurants.
IMO, a height restriction on the hard rock location is a perfect example of impotent virtue signaling. The building being tall had literally nothing to do with its collapse. It collapsed because of poor design, inferior materials, and criminal dereliction of duty by city inspectors who signed off on various stages of construction without ever setting foot on the site. Putting a height restriction does nothing to fix the problem that NOLA’s building inspectors can be paid off to approve unsafe construction methods on high profile projects.

Does anyone know what happened to the city inspector who falsified inspection reports? She was just starting to really catch heat when the COVID shutdowns erupted and she fell out of the headlines. I wouldn’t be surprised if she still worked for the city.

Mohan Kailas (one of the developers) is a gigantic piece of shite. He has a history of being a gigantic piece of shite.
If the City Council had an ounce of intelligence, they would force him out if they want approval of permits.
What happened at the project lies at the feet of Mohan Kailas.

No one could make me do sub/par work or construction. The contractor and engineering firm who agrees to do the job have to be able to stand behind their work. You are a piece of shite company if you agree to do work that you know is unsafe and not up to standards and then blame it on the guy who hired you!

Did they ever take the time to get the bodies removed?

This article says that two of the inspectors retired and the third resigned.

After the news stories, Montano moved to fire Tweeter and Treadaway and officially cited Dwyer for violations, although he had already retired by then. Treadaway resigned. Tweeter appealed her firing but withdrew the appeal and retired.

My guess it will be shown that the design and specs could not support the structural weight of the building. Developer and engineer are responsible for that.

If you know the cheap arse Kailas' like I do, you know they where cutting corners whenever possible. Combine that with not paying their bills and contractors and nobody gave a shite.
