Grand jury indicts Melanie Curtin in connection with Dennis Perkins rape case

IVINGSTON PARISH, La. (WAFB) - A Livingston Parish grand jury has indicted Melanie Curtin, the third person arrested in connection to the Dennis Perkins case.
The grand jury returned two bills for aggravated rape and video voyeurism on March 3. An indictment simply means a grand jury believes there’s enough evidence to proceed with a trial in the matter.
According to filed documents, Curtin allegedly “…participated in the rape of an adult victim, with the assistance of Dennis Perkins, without lawful consent of the victim” on or around Nov. 8, 2014.
On the same date, she’s accused of video voyeurism in that she allegedly, “…assisted in using a camera, videotape, photo-optical, photo-electric, or any other image recording device for the purpose of observing, viewing, photographing, filming, or videotaping a person, an adult victim, without the consent of the victim to the specific instance of observing, viewing, photographing, filming or videotaping, and for a lewd and lascivious purpose.”

Can someone answer this question for me? I am pretty sure the answer is yes, but I just want to make sure.
Let's say Dennis Perkins's wife passed out drunk.. Or on whatever. If Dennis Perkins & Curtin engages in sex with the wife, since she was not able to give permission, that is still rape right?
Now let's say after the wife wakes up and becomes aware of what they did and she says she has no problem with what they did.. Does that change anything? Would she have to press charges for anything to proceed legally?

For the first part yes 100% that’s rape.
No idea on the second part other than I don’t think it’s necessary for her to press charges. A crime was still committed so if you had a prosecutor wanted to I’m sure they could prosecute
