Not by itself. If you don't act in a criminal way, there is no crime. Murders have been categorized by "thought" for a long time (e.g. premeditated, hot blooded, criminally negligent, etc.) with different punishments based on the state of mind or "thoughts" of the murderer as evidenced by his actions. Hate crime is an extension of that, a completely unnecessary extension, but a mere extension nonetheless.

Hate takes energy. That's energy they need for excessive celebrations, tearing down statues, making lot's of noise in situations that normally are more reserved, energy needed to shout at the movie screen, energy to stand in the middle of the street,energy to keep pulling up their sagging pants. Ain't nobody gots energy fo dat.

Although I don't whole-heartedly agree with the law in all aspects, but if you pick out about 80% of those crimes I'm fine with it.
It gets fishy when "battery" comes up. Battery is described as "intentional touching;
the touching must be harmful or offensive;
no consent from the victim.". With this definition I'm fine with it. If you want to break a law in doing anything to a uniformed police officer, you should be held to a higher standard. I hate cops as much as the next person, but there are still some that have a positive mind set, and usually do their job to the best of their abilities. Just like in everything else (think racism) the majority of shitty people give a bad rep to the minority that are doing good.
This law doesn't make resisting an officer a hate crime, unless you hit him. There will be tons of BS cases where relatively innocent people are going to be skrewed, but you can insert the OT's favorite saying here: "play stupid games, win stupid prizes"
All cops are in a position of authority, and most are on a power trip. Treat them the way you would want to be treated in that situation and 99.9% of the time you will walk away just fine.
