Got a speeding ticket, considering contesting it

Pulled over right as the basin bridge starts, westbound i10. Right as the limit drops. He pulled over 2 of us out of a crowd, and other guy had just cut me off. He said I was going the faster of the 2, even though the other guy had just moved in front of me.

I remember hearing back in the day, that if the officer does not show up for the court date then the ticket is dismissed. Do the officers always show up? And if so, what happens? I imagine if I just get to state my case, and it's my word versus his, what's the point.

It would cost me more to waste my time going to court than just paying ticket

Unless you have some prior tickets id just pay it, most insurance carriers wont burn you for just 1

Were you speeding?

If yes, pay ticket.
If no, contest.

Also, we need a speeding ticket board.

Tell the judge you're an Ole Miss fan.

He'll probably (logically) reply that your suffering is epic and y'all are stoopit.

He might let you off contingent upon you leaving the State forever.

LSP or municipal? If local, call the courthouse and ask what you can do to keep it off your record. Pay the thing and keep it off record b/c that cop will show up.

If it's LSP, there is a good chance he won't show up.

I contested one and they made me go back two or three times before dropping it. It was in a school zone. The police officer said he stopped me because I hit my brakes. I said I tapped my brakes to get cars off my tail. He said "go to court."

Out of my 2 tickets:

one time mynofficer didn't show up so it was dismissed.

Second one was negotiated into a nonmoving violation.

He was being a dickhead like usual daring you not to show up and get yourself a bench warrant REGARDLESS IF THE OFFICER SHOWS UP. YOU HAVE TO.

You'll waste more time and money fighting it than you would if you just plead guilty and get it dropped to a nonmoving. All they care about is the conviction rate and money so most judges offer plea deals that are too good to pass up, namely being that a nonmoving won't affect your insurance rates.

Just be very careful for like the next 6 months and don't speed or get pulled over again and it will be fine.

The statue of limitations is your friend here.

This is correct, but I have an old buddy who is a cop, and he used to show up to all court dates. Said it was much easier than being on patrol. Not sure how many actually do it, though. You’ll probably end up paying the ticket regardless. May be able to plea it down to a non moving violation if you’re lucky.

Ahh, yes, the old "But he was breaking the law, too" defense. Try to get a plea deal beforehand, pay your fine, and take your lumps.

This is correct. You have the constitutional right to face your accuser. If the cop doesn't show, you walk.

If you don't show up, a bench warrant will be issued for your arrest. This is a bad thing. You or your attorney need to be there.

That said, usually fighting it is a waste of time and money. You need to be able to show that the cop was wrong. This means digging into calibration records or maybe showing the speed limit wasn't what the cop thought it was (I beat a ticket this way once).

But don't bother trying to argue a judgement call. If he got you right where the limit dropped, then you were speeding. What that second driver did isn't relevant to your case.
