I get that, but that would take a monumental frick up by the finance people for it to be something legit causing a $100 increase on the monthly payment.

This might be the issue though. Like they approved him for a rate he didn't qualify for and the bank didn't finance the loan.

And like rando is saying, at that point, there is no obligation for him to agree to the new rate or cost. He can walk away free.

Again, that is a gigantic miscalculation to increase the payment that much. That kind of miscalculation is incredibly unlikely.

I know the software may have changed, but the Finance guy typically sends out the customers info and banks typically auto send an approval or denial, OR needs to call the bank.

For them to frick up that bad means the Finance guy wasn't the person doing the deal

If these things weren't done electronically, you might have a point. I stand by that kind of error being extremely unlikely.

Regardless, they are way out of their window to try to do anything about it. OP's "buddy" is a dumbass for even talking the the dealership again about this, let alone actually giving the truck back.

Well the question is if the loan was funded.

If so, he can say get lost.

If not, he has to bring the car back, per the loan document you posted.

Yes. And no.

The original contract is null and void. His truck is unregistered. It is in their name.

He actually has zero rights to the truck.

In 60 days, he hasn't made a payment. 45 is the typical max.

If the loan isn't funded, you don't own it though. Per the contract you either bring it back or pay it in full.

If it's been 60 days and he hasn't made a payment, he has no right to it.
