Admittedly, someone messed up for it to take two months, but he still should have gone in dry on the dealer and renegotiated a much better price to more than cover the difference in interest and his wasted time.

He wants his truck.

The dealer does not want a two month old truck with miles and blemishes.

So he goes in to resign, points out he's effectively signed for a used truck. Renegotiate price. Warranty for free. All of it.

They will cave. Why? Because if they don't they lose their asses.

Your buddy should've slowed down and contacted a lawyer to see what options he had. He could've made out like a king but screwed himself over.

I'm not familiar with conditional delivery. But obviously the dealership fricked up royally with the financing. And even without that, they fricked up by trying to squeeze another $5000 out of the buyer 2 months later. Now they get to take the truck back and have to sell it as a used/demo model at a discounted price from the brand new price because OP's buddy drove it around for 2 months and probably put 2000-3000+ miles on it.

Baw should've smoked a pack of Marlboro's in the truck with the windows rolled up before he brought it back just to stick it to the dealer some more.

He had two options, resign on different terms (theirs or his) or return the truck and walk away.

How would that work though? They already have his signed paperwork, that you say "protects" both of them locking in the original price. You can't just bend it in whichever direction you wish.

The way it'd work in your contract would be if they couldn't get financing within 10 days and then were able to approve you at a higher rate, but you'd have to come in and sign again.

They couldn't just up the rate or cost without you signing to it.
