The Louisiana Civil Code article 2589 permits rescission for lesion beyond moiety. It states that the seller may rescind the sale of an immovable when the price, or the property it is exchanged for, is less than one half of the fair market value.

Wouldn't a public auction establish the fair market value at 10k though?

So when Cosman went to the auction late last year, he was the only bidder. He pulled the trigger for $10,000, after the attorney representing the city-parish said he could bid whatever he wanted, noting the Metro Council would have to approve the sale.

I mean I guess just to make things look like they are on the up and up he didn't bid one dolla

What constitutes the minimum effort to make an auction public. I sure as frick didn't know about it and could have brought $10,001 to the auction to get that lot.

Also, what about the misrepresentation of the land for sale. It's current zoning and potential zoning roadblocks, current state(the parish had been maintaining it), etc.

it's actually a pretty crazy story. he owned land close to it and would always see a plane fly real low over his land. never could figure out what was going on.

then the power meter guy came on the the land in question and took a wrong turn. found acres and acres of marijuana. he was seen on his exit, told the police when he got back to town. police came the next day and the whole crop was gone.

they raided the storehouse and found tons of weed. landowner goes to jail. he was growing and moving weed and the planes were dropping cash in the lake. the sheriff ( can't remember?) let him know land next to his was about to be on auction. he buys it at a steal.

a few months later, parents of weed grower show up to friend and ask if they can bring their grandson to see the land he was raised on. they agree, meet at the entrance, grandparents never show. they head back to the house and see a car leaving the cabin. go in and can't find anything missing. they come to find a false floor they never noticed was ajar. get to looking and find a bunch of stuff was dragged out and a few stack of cash were still down there.

really weird that the council approved this without batting an eye. Either something fishy is going on or they are just horrible business minded people.

I would love to see the campaign contributions the council got (directly/indirectly) from this developer.

The big problem is, it is probably all indirectly with different names/corporations to throw us - Joe Taxpayer - off the scent. And by scent, I mean foul stench of corruption.

Former Metro Councilman Ryan Heck carried the deal through the process last year. Several years earlier, Cosman—a friend and Heck campaign contributor—had asked him for help buying a separate, 22,000-square-foot plot of wooded land behind his house, and Heck obliged. Cosman got that piece of land at auction for $50,000 after another bidder showed up.

Well we know they are buddies and Cosman contributes to the campaign. But I am sure everything was on the up and up on both deals.

Not if no one else knew about it and they only had 1 bidder. And especially, with the value of the land around 700K that gets sold for 10k!

It went through the legal process and the public auction was advertised in the paper, just like every other public auction. nobody paid attention

it's one of my favorite east texas stories.

most awesomest about it is that my wife's grandfather was a pastor to the guy who bought the land. when the dude was a young pup 40 years ago, he needed a loan to get a deal started and her grandfather gave it to him. dude goes on to be a millionaire. he idolized her grandfather after that and lets us come out there to fish, atv, swim a few times a year even after her grandfather passed.

Yeah. That's it. Nobody was paying any attention at all to a busy corner lot at an intersection.

There are scores of "developers" in this town which this is their only job. No way it doesn't get AT LEAST two bidders.

Yeah, but it's not what you think. He only created an account as a "joke." Haha!

I'm still trying to figure out who the joke was on....

It was posted in the Advocate, the New Orleans Advocate, and the Acadiana Advocate on 11/21/16, 11/28/16. and 12/5/16.

Nobody was paying attention.

Well assuming it was advertised properly as the article said it was. I would think he could make the argument no one else was interested since no one showed up to bid.
