Federal lawsuit blames suicide of EBR inmate on synthetic marijuana

Johnson was found hanging from a bar in his cell at the East Baton Rouge Parish Prison, suspended in a “semi-standing position” with his blanket knotted around his neck, according to a guard’s report. He died at a hospital on June 10.
quote:
Johnson was found hanging at 10:22 a.m. on May 30, 2015. Prison records show guards had last checked on him at 9:43 a.m. and 10:10 a.m. There aren’t typically cameras in cells at the parish prison, due to low ceilings. Footage of the hallway where Johnson was being held doesn’t appear to show any foul play.

Now, in a federal lawsuit filed Thursday, the family is offering another explanation: Johnson committed suicide after ingesting synthetic marijuana. The lawsuit claims the drug is widely available in the jail and tolerated by guards. Synthetic marijuana, which is not the same drug as marijuana, is a catch-all term for a type of chemically-sprayed plant substance that has been reported to cause psychotic behavior. “(East Baton Rouge Parish Prison) guards participate in, and profit by, or at least negligently permit, the smuggling of drugs into (the facility), primarily ‘mojo,’ synthetic marijuana,” wrote lead attorney David J. Utter, in the complaint filed on behalf of Adrienne Lewis, the mother of Johnson’s young biological daughter, Liyah.
quote:
Franks said she’s aware her son may have sometimes used marijuana, and could understand his wanting to smoke it if offered to him in a stressful situation like jail, but she said he was unlikely to knowingly use “mojo.”
TL/DR: Momma's sweet little baby smoked some bad dope in jail and is suing the jail.

That is some dangerous stuff.

Not surprising that even when dead, this mother thought her baby didn't do anything wrong and there is always someone else to blame for his frick up.

So the guards didn't do their jobs and someone got hurt...and the mom is the problem?
That's a lot of shite arse logic there, bro.

Jussayin'...i smoked a ton of pot in HS and if youre mom knows you smoke you dont just "sometimes" smoke weed...

Sounds to me like he voluntarily took a drug in jail, if you "Sometimes" smoke weed you can plainly see the difference in fake shite and real shite. Unless someone forced him to smoke it then that was his choice and it was a bad one and he paid for it. Do we need to hold everyones hands as they walk through life now?

Synthetic marijuana, which is not the same drug as marijuana, is a catch-all term for what equates to meth-lite. It is bullshite and people are dying and going crazy because our shite head government allows things like meth covered plant matter to be sold over the counter in gas stations with no regulations, restrictions, or age limit, while keeping marijuana, a plant with both recreational and medicinal benefits, strictly and completely illegal for no reason other than lobbyist pressures from groups who would be economically hurt by the regulation and taxed sale of marijuana.

It appears that Johnson’s family has filed against every individual working at the prison during his incarceration and prior to his taking his own life. It’s unfortunate that they have to deal with these sorts of allegations,” Hicks said.

I don't understand the market for synthetic marijuana. But there is one.
There have been arrests made here where people had several lbs of it.

Read the article. Originally the family claimed the guards killed him. When the video showed that wasn't the case they changed their story to the guards sold him drugs that caused him to kill himself. Yeah right. They are just looking to get some of my tax dollars. Here is an idea, go work for a living.

Yeah this is nothing but a money grab.
They went after the guards because, of course, they were sure it was the white devil guards that killed him.
Well that idea failed
So, wait, nope the white devil guards did kill him. They let mojo in and that's why the guy died in jail.
So pay me!!!!!!!

Unless the prison can prove an inmate smuggled in the mojo, the prison didn't do its job.
It is the prison's responsibility to keep drugs out and they didn't do their job.
So they will end up paying.
Maybe not as much as the family is initially asking, but they will pay.

That's not how it works. The plaintiff (dindu momma) has to prove negligence against the prison. The prison has to defend the allegations. The prison doesn't have to go out and prove anything.

Guy willing ingested it.

It's the prisons fault because they were responsible for making sure he didn't take drugs? BS. Where's the personal responsibility?
If I OD at work next week, should my family sue my boss? If I hang myself from my bookshelf in the office does my employer get sued?
If my high school cousin overdoses, do we sue the school?
What if my nephew gets shot after robbing a convenience store? I guess we sue the city..oh wait.
The guards are there to make sure people don't bust out. As long as prisoners aren't breaking free, I don't care if they hang themselves. Their choice to lead a life of crime and their choice to end that life however they deem best.
