You think? He chased them down, forced them to crash their vehicle, then continued pursuing them and shot them both. It has been a loooooong time since that wasn't an over the line response to an attempted theft

Don't try and steal a car and it wouldn't happen.

In his defense, this would have been justified in space...

Its a murder and attempted murder--both of minors.

This guy would be getting mandatory life in prison Louisiana for this, FWIW.

I find it hard to believe this guy gets convicted of murder in most places.

Should be able to chase down and open fire on car thieves on public roads?

On your own property...... depending on the circumstances, I could possibly understand, but giving chase in vehicle while putting the public in more danger with your actions is inexcusable .

Yes, you should be able to chase down people who are trying to break into your property. You should be able to detain them. If they will not let you detain them, you should be allowed to incapacitate them using whatever method you have available.

Attempted theft isn't a predicate felony in Colorado for first degree murder/felony murder.

But burglary and attempted burglarly is. You have to burgle the car before stealing it.

Wouldn't be felony murder even if it was, because the dead kid was an accomplice to the crime.

Sounds like dude was a party to the underlying felony. It also sounds like the person being hypothetically charged was very involved with the felony leading to the death of his accomplice, which is exactly why it fits.

So, basically we have two thugs and a dude with severe anger issues off the street. Sounds good to me.

Schur was arrested after the shooting and charged with first-degree murder and first-degree attempted murder.

I thought that "first-degree murder" is generally pre-meditated murder.

If people were legally allowed this response, there'd be a whole lot less "theft".

If police and the criminal justice system was working properly, there would be a whole lot less crime of all types.

Why? It’s pretty open and shut.

I have a hard time imagining a jurisdiction where he wouldn’t be convicted. The pursuit is inexcusable and unjustifiable.

Burglary involves entering a structure. Car is not that.

As I’ve already explained, Colorado’s felony murder statute excludes the death of an accomplice/co-party to the underlying felony.

54 years is way too long. Guilty, but not first degree- he didn't plan this out.

frick that. If someone is about to or in the middle of stealing something you have to assume they are armed so the only way to confront them is to be armed. He was protecting his property. That's the risk they take when they decide to try to steal people's shite.

quote:

“This was vigilante violence at its worst and now a young man is dead,” said Adams and Broomfield Counties District Attorney Brian Mason.

How dare he not just let them steal from him. I know he went chase them in his vehicle an all, but.. And I know this isn't a legal argument, but he wanted to make sure they wouldn't try to steal from him again. Don't give me this shite about "vigilante violence" and "a young man is dead". A man who was trying to protect his house and belonging shot someone who was trying to steal his shite. He didn't know their age
