i have a friend who fought in Bush's wars and it fricked him up. major PTSD where he had to go to Arkansas to a special treatment place just to keep him from going off the deep end (this was shown on a national news story so it's not so private i can't discuss on this board). 22 former military members commit suicide a day due to PTSD a day.

i had to kind of my dad die a few years ago in a pretty agonizing fashion and that fricked me up pretty good with things relating to death

to call mental suffering and psychological problems "emotions" is one of the legit dumbest things i've ever read on this board

Insurance companies always willingly accept when their insured fricked up and pay out fairly. 100% of the time.

........because that is an adequate comparison.

what else is there?

do you have a time machine we can use instead to allow people to go back and avoid the incident(s)?

would you prefer to legalize vigilante justice?

you do understand the Western tradition has allowed these sorts of suits since, at least, the Roman Republic? this isn't something lawyer's came up with in 1985

This is typical lawyer BS. My mom bumped a guy doing 15 mph and that caused him all the same, ruined his sex life and his marriage and caused his mother in law to die. No shite. If your in pain, call Blaine. This is typical and not an indictment on Ensminger who has definitely faced a terrible situation.

Ensminger deserves compensation if it is found that someone was at fault. That’s why insurance is paid for.

Also the lawyer that was trying to throw the insurance company under the bus for suing the policyholder, it sounded like the insurance is ready to pay out but is unsure of how to split out the money amongst the claimants and wants the court to decide.

It's fricking insane, honestly. People tend to privilege their own emotions and call it logic when it suits them.

I hope the bus bench crew in this thread is billing chicken for all these hours spent litigating

Slow, will you agree that even if the guy didn’t suffer any mental anguish the lawyer would still put it in the lawsuit? In the case of Ensminger, he obviously did, but not every person in an automobile accident does and I would bet that language is in nearly every lawsuit.

Your mother shouldn’t have rear ended him.

Also this is a slightly different situation.

His very young wife DIED as a result of negligence.

My god you anti lawyer people are batshit nuts.

If this is truly the reason for his lawsuit then he will donate 100% of his lawsuit or settlement proceeds towards flight safety. But let’s be honest, that will not happen. If he keeps any of the proceeds then it’s just a personal money grab.

Well yeah

You have to put any potentially valid claim or risk losing the potential of amending it later to include the claim

Accidents happen and she didn’t rear end him. And I’m not saying that the lawyers claims In Ensmingers case aren’t true, I am just saying that every personal injury lawsuit is gonna have that type of claim in it whether it is true or not. In Ensmingers case it is definitely true. So it appears that you misread my previous post as I stated that this is the way things are done by lawyers in every case and not an indictment on Ensminger, even though the claims are definitely true on his part.

You can claim almost anything in a lawsuit. You won’t get paid for it however. Defense lawyers can file motions to have specific claims dismissed and so all the time.

Yes you can, and these false claims in every lawsuit are what give lawyers a bad name and have people posting vicious attacks on a man that has truly suffered. Don’t shoot the messenger.

There are a lot of butthurt plaintiff’s attorneys in this thread. I wonder if it’s because of all the reform bills sailing through the legislature right now? Maybe they need this thread to blow off a little steam. Then again, maybe they’ll sue Chicken because of the mental anguish they’re going through right now? We need to pray for them...and I guess Chicken needs to lawyer up? Somebody is hurting and somebody else will pay!!
