Yes it is illegal and yes you should jump on a class action.

Is this sarcasm? We do some projects that require the workers to be vaccinated. As a company we had to find out who is and isn’t vaccinated. We don’t share the information with our employees but it doesn’t take a rocket scientist to figure out who is or isn’t based on the projects they’re on.

ETA: Sharing the list seems questionable. Could they have been dumb enough not to run it by the lawyers?

My question is what do they hope to gain by this other than shaming the unvaccinated, which is pretty fricked up. Either tell people they have to be vaccinated to work there or they don’t. This is passive aggressive.

I wouldn't. But my lawyer would.

That's not the same as sending out a company wide list.

Not HIPAA. However, it’s a major ADA issue.

Pull out the trusty old policy manual and see what policies they have about protecting employee's personal information. A lot of larger companies have HIPAA type clauses/language in their policy manuals.

This would be the first thing to look at. It isn't a HIPAA violation, but could easily violate Personally Identifiable Information clauses in corporate policy.

Do we know of any employers who have done this? Sounds like a disaster and class action lawsuit waiting to happen.

Not HIPAA, not illegal...

Hospitals have been doing this for the past 2years in one form or another (different masks for those Vaccinated vs Non-Vaccinated for example)

I wouldn't care. I am not ashamed of being unvaccinated. Quite the opposite. It shows my ability to think for myself.

I think vaccinated vs unvaccinated in this country is about 50/50 now, so I don’t see much consequence either way. As a result, I probably wouldn’t do anything one way or the other. That said, I can think of no better way to have employees invite a union in to represent them, if the company is pulling this kind of bullshite.

I don't think you can use a black and white vaccinated/non piece of data to identify someone. PII is about information that can be used to steal an identity or identify someone, not about anything you might not want anyone to know.
