This. I doubt she's actually looking to get money. She's just positioning herself for them to drop the suit, or if they do go through with it, she'll be able to offset her legal fees with the counter suit. If anything, I think it's a little "poor form" for the parents to sue with what sounds like absolutely no evidence that she did anything neglegent. I understand being upset, but it sounds like the family is just grabbing at straws to punish a lady who happened to be in the wrong place at the wrong time. I know emotions run high and I don't know what I'd be doing if I lost a child, but that's just my outside view of it.

It might have helped to prevent those accusations had the police actually gave her a breathalyzer, which luckily is mandatory here in Louisiana in all traffic deaths
Wonder if her husband had any influence on that test not being administered?

The boys parents are using for medical and burial bills. The driver wasn't really cleared. She admitted to speeding. The didn't give her a breathalyzer because they didn't think she was drinking. I find funny that her husband is a cop and was driving right behind her. We know how cops take care of their own. Now if they would have have her a breathalyzer and she passed it, then yes, they cleared her of that. From the article, it sounds like she didn't get any tickets or anything. Hard to believe the cops wouldn't after she admitted she was speeding. This is what leads me to think her husband being a cop has influenced the way the investigation went.

Well, in her claim she blames the kids for not braking correctly. If she can use that, then the family can use her speeding(even if only 6 mph) to show she didn't drive correctly. If someone is going 5 over and rear ends you, are they at fault? Yes they are. If someone died in the wreck, they might even be charged. They damn sure would get a ticket.

That isn't the point. The point is she wasn't driving responsibly during wet conditions and it might be a factor in her hitting and killing people. Yes, she is to blame for this.

OK I get what you're saying. So really both cases should be thrown out because both the driver and the kid were at fault. That's probably the best outcome here.

The kids were driving their bikes on the road at 1:30 am in the dark and didn't have any sort of lights and their reflectors were not adequate. Yes, I agree it's a tragedy but everyone is making it sound like she was roaming the streets mowing down teenagers.

Says after 1am on Oct 28, 2012 which was a Sunday. So I'm reading that as early Sunday morning (late Saturday night).
I agree that it is super fishy and it seems her husband pulled some strings to protect her. But, on the other hand it also seems that the kids were in the wrong as well.
Like I said earlier, it's just a bad situation. 6mph isn't going to make a difference. For those wondering and not wanting to do the conversion, she's admitted to going 56mph in a 50mph zone. It's in Canada so it was km/h (90 in a 80).
eta-Speedy, I agree with you and wish there would have been a breathalyzer administered at the time of the accident. That would have cleared up a lot. But, it wasn't so this is what we're left with.

Sounds much more like the kids were more at fault than she was. She also wasn't even going that much over.
