typical LC logic. Just build it. Think about it later. I grew up in LC 60s/70s right on 12th st. and south LC was the big boom. Every damn bean and rice field became a development and all that shite past the old "dump" off Country Club was primo acreage. All sitting on a landfill. The area by the casinos will continue to sink. But houses will continue to be built and the neuvo riche will claim them.

I played Mid City. You must have had to play for the short lived North Lake Charles?
I had many friends playing for South Lake Charles and we always competed hard through league and high school.

That swale was part of the existing condition. When you removed that, you are supposed to provide a comparable condition. Basically, you have to provide a replacement for the swale.

I have had to deal with this....as the person on the lower side....get a lawyer to work it out. There are specific surface water laws in place but are tricky and depend on the state. Easier to just get a lawyer to deal with it.

Was it a formal notice on intent and went to a trial court? Would you say that one claiming to be a precarious possessor could not prescribe if the landowner said that he was aware of the servitude and allowed (tacit) permission prior to the thirty year Rx?

My area wasn't swampland. It was the high ground between the Walnut Grove and Barbe court area.
And to those talking about pricing, greywood is as expensive or more and so is the geddings is just as much and see, nothing in oaks of Hyde so unless you want to pay out the arse for being way out in greywood, not much to choose from of you want to be in a neighborhood.
Walnut Grove is nice but I preferred Terra saint.

You need to go pull the historical topographical maps or original subdivision outlays and confirm who is the real servient estate. Many times development of lots around an empty one will alter the natural drainage and may conceal the true historical relationship of the lots. In other words, it may actually be the neighbors who are in the wrong here and they just don't know it because they were used to having a vacant lot next door.
All of this should be on file with the Parish and your builder should have consulted these documents when doing the fill plan. Do this NOW because you can bet the neighbors and their attorney are. Be prepared when you get that demand letter telling you to bulldoze your house or else.

Well city says your wrong and the city engineers and planning is willing to put it in writing. But I'm gonna talk to him about it and try and come up to a solution.

As an SHHS grad I was getting ready to ask the LC guys their graduation year and high school to see if our paths might have crossed in the past. But with OT detectives lurking I have thought better of it.

Dude, calm down if anything I would just put drainage in, nobody is bulldozing a house. The topographical maps were consulted by the city engineers and planning division when I had to submit the storm water run off plan. They approved my plan and are saying he has no claim that I impeded the natural drainage as the Swale was not part of any approved or drainage system and that the drainage for his neighborhood is supposed to flow towards the front.
My lawyer neighbor dealt with this also when he built and city ruled in his favor. He did add a couple drains to help the guy, which I would be more than happy to do except I have the main fiber optic cable running on our adjoining property line.
