Judge told prosecution that their rebuttal witness could not mention the lab test results and out of the gate he starts with it. Objection...Sustained... no mistrial

Prosecution wanted to introduce rebuttal evidence. The evidence is a study of the carbon monoxide levels in GF on day of death. They never introduced this study into evidence. But yesterday, the defense witness indicated he could of died from monoxide from car. Prompting Dr. Baker (prosecution witness) to call the prosecution last night to tell them they have a study that was never provided by Hennepin during subpoena. Defense argued they had ample opportunity to get this evidence and discuss it.
Judge ruled cannot talk about the study but can have Tobin back on the stand. Warned prosecution if study is brought it up at all, mistrail. Prosecution got damn close to the study being discussed. Defense turn to cross. I think thats a good summary - idk.

Yes.
Defense called a witness yesterday (Witness 1) who mentioned carbon monoxide.
Prosecution moves today to re-call a previous witness based on testimony of witness 1 because they claim they didn't know that Witness 1 would say what he said.
Witness 1's testimony was all documented in his report that the proseuction had.
Nelson said additionally he doesn't want the witness to mention a "Test" that was supposedly performed based on testimony of witness 1.
Nelson received notice of this test yesterday. Why wasn't this test presented in this guy's initial testimony?
Nelson says he will move for mistrial if this guy mentions the test.
Judge says guy can testify but if mentions test it will be mistrial.

so... from what I can gather
since defense brought up carbon monoxide poisoning... prosecution found a study they wanted to use to refute it
defense objected saying no... you knew about this already and decided not to act on it during the presentation of your case... tough titties
judge apparently said you can re-call the witness who found the study... but you best not ask said witness about that study
prosecution towing the line of trying to talk about the new evidence but not really talking about it

They called the judges bluff. I mean he explicitly said he can’t testify on the new evidence and they did it anyway.
I mean it’s a win-win for the prosecution, they either mistrial and get another shot at Chauvin or they get the jury to hear about the evidence even after the judge disallowed it.

Since there now is the appearance of the judge being favoring the prosecution, what can Nelson do?

Interesting that the prosecutor didn't try to get him to dispute the enlarged heart. Wonder if he was worried that he or the witness would say something wrong.
