I would say not very often at all. But remember, the Government, in my humble opinion, should never even bring a case, much less try it if they don't think its a slam dunk. So likely a precarious spot for them, if they think that they have issues.
as far as repercussions, sanctions would be available in Louisiana / or Federal Court. But would likely have to prove that was absolutely willful on behalf of State.
Someone mentioned above "opening the door", and Nelson better be DAMN careful about form and substance of his questions. Otherwise, could legit do so, and essentially overrule the judges prior exclusionary order.
