re: Derek Chauvin trial - GUILTY ON ALL CHARGES. Update: His sentencing is today

I wouldn't be surprised if the judge does declare a mistrial.

Judge said he would if the prosecution brought up the test and he let it ride when they bought it up first thing.

Either mistrial right now or good grounds for appeal down the road.

I've been wrong before,though...

The slide they referenced said that Floyd's carboxyhemoglobin could have increased by 10-18% (not TO 10-18%).

Even if his number was 2, then a 10-18% increase would only be 2.36 max which is still in the normal range. There really isn't a need for this rebuttal witness.

Nelson pulling his hair out right now...... cause he caught between Scylla and Charybdis.

He could bang on the table for a mistrial, likely warranted.

OR... he lets it ride because he thinks he way ahead, and does not want to give them a chance for a redo.

Murder case previous, find out via one of alternates that two jurors went to crime scene to view lighting night before closing (HIGHLY inappropriate). Some "things" came out on last day, that never again would the State allow to happen again. I begged my team to NOT ask for mistrial. They convinced the young buck at the time that legally and ethically had to. (they were right, but i still felt we were winning) Mind you, the actual jury is deliberating at the time. I ask for mistrial. Judge grants. Thrashes certain jurors. Later find out of the 11 remaining, all were in favor of NG.

So, Nelson might not want mistrial .

The carboxyhemoglobin test was a new test (and couldn’t be mentioned)

The arterial blood gas is not a new test, they discussed it previously when talking about Floyd’s carbon dioxide levels.

I’m just trying to be honest with y’all. The prosecution did not violate anything there.

Where I think they fricked up is they said Tobin was going to present new research that proves hypopharynx compression. Instead, he said there is no research because it’s common sense that every doctor knows and we don’t research common sense things.

Anyone catch that discussion where Nelson was saying the the prosecution told the judge that Toobin was going to testify about new evidence at 5 pm last night but didn't inform Nelson that the test existed until 8 am this morning?
