yep, and a jury should be aware of that, if I say(on the stand,) as a layman, that GF was breathing because he wouldn't shut up babbling and yelling that's just an opinion, but if a doctor(hired or not,) says the same thing, that's an expert opinion

And your opinion would be met with an objection based on speculation, while the doctor would be allowed to continue. Otherwise, the jury would have been stuck listening to medical opinions from all the bystanders during the first days of the trial.

point is, that using the term "expert witness" is a ploy to try and sell it to the jury, not that the individual is necessarily truly knowledgeable/credible in that field any more so than a layperson may be on the same subject
