Defense trying hard to not allow this witness opinion on what Chauvin should have done without the fact he looked at ALL the facts not just a few.

If allowed, this guy is gonna say Chauvin should have removed knee which is what Prosecution wants.

Judge letting it play out without Jury to decide.

It is voir dire, he's basically trying to verify the expert witnesses background to judge for himself if he is experienced to answer a certain question the prosecution asked, so he knows if he will object or not.

I think the presumption is he was being hysterical and full of shite.

Doesn't change the fact that at some point, he def. stopped breathing. Drugs or the knee, that's the jury's decision.

But him yelling he can't breathe for 10 minutes is irrelevant to me.

Sounds like maybe no because the Judge doesn't think the Sargeant has ultimate say.

Or something. This is tricky.

Glad the judge is managing this one. Feel like shite like this in the OJ trial was a disaster and judge would have just let the jury stay and hear shite that wasn't necessarily legal.

So absent the video, what part of the report lists findings that would lead you to believe that a person had been asphyxiated, especially since the report doesn't use that word.

I'm saying that somewhere other than COD there should be evidence of this asphyxiation, no?

For instance, if you found a dead body with no signs of trauma and no clear manner or cause of death, are there markers present in the blood that could prove that the person suffered a heart attack?

So in this case, what evidence is there that the felon asphyxiated? We know he died, but what trace evidence or lab analysis exists to support that (like there would be in the heart attack scenario)?

Well if that was PROTOCOL then that’s different from “what would you have done” because even following protocol (if it was) no one knkwsnif it would have helped.

That was a BOMB.

Going to be interesting how the defense handles this. He had a good argument to keep them from asking that question but the Judge wasn't having it.
