I"m not saying anything definitively, b/c i dont' know the facts, and neither do you.
You have no idea if they actually had consensual drunk sex, or if they raped her. I understand what the law says, but that doesn't mean she still didn't give consent. but i'm sure you'll just come back with the law and that it has to be rape, even if she was inviting it on. and i say that having absolutely no clue if she did that or not, but what if she did?
I asked a legit question. what happens if both parties are stupid drunk?
and i'm not saying that to defend them, and i'll say it again that it's extremely likely they raped her.
I do have a problem with this mindset that just b/c someone is legally drunk that if they have sex with someone it's automatically rape. And again, i'm not saying they didn't rape her. I'm strictly speaking about the law.
