You think shaking a baby until its brain hemorrhages is just a "stupid mistake". Locking my keys in the house is a stupid mistake... not this.

So, when did you shake a child to death? Or make a mistake on that level?

I like how it's assumed that the only possible way this kind of trauma can possibly happen is by picking the baby up and violently shaking it. Accidents happen, the kid should not have been sent to a day care at 2 months old.

If there was proof that this is what happened then she would be in prison and I wouldn't have any problem with it. A judge that is much smarter than you and I about the facts in this case made the call to put her on probation. This was very likely due to the lack of proof that she intentionally killed the child.

I'll respectfully disagree.

She didn't intend to kill the child, but she intended to cause harm.

ETA To elaborate, the death was an accident. The harm caused as a result of the shaking was not. She should have been jailed if the child survived.

And you have absolutely no evidence of that, and apparently there is none.

This is an emotional case, but really sending a girl to prison isn't going to solve anything or bring closure to anyone.

How do you define "assume?" I am basing my posts on the professional opinion of a medical examiner.

quote:

The doctor said it was “more likely than not” that Brody’s injuries resulted from being shaken.

the kid should not have been sent to a day care at 2 months old.

I really need you to explain what exactly this means.

If you need that sentence explained, you should probably look into English as a Second Language courses.

They do? Really?

If so, they are shitty parents

It was a plea deal... the judge then signs off on the recommendation. It's only a formality. Don't try and hide behind the judge on this.

But the harm caused was death. Your statement is contradictory and your argument is invalid.

No shite. We are not in a position to sentence this pig, so we have the ability to form an opinion that is not beholden to the standards of the courts (eg beyond doubt). Explain how this could happen if not some act of physical abuse. And remember, the excuse has to be something a doctor would not be able to determine.

Many families do not have any other option outside of daycare. And I'm not talking about just poor families either.

It was actually a way for you to back away from the absolutely asinine implications of your dumbass statement.

If the daycare set the age for accepting kids at 2 months, than should be able to keep the two month old alive, you stupid stupid mother fricker.

Terrible. Absolutely terrible.

This is such a tough case. If this was indeed an accident and there was true remorse I'm not sure prison is the way to go. People automatically think that putting someone in prison is the best way to handle everything. The worker didn't intentionally kill the child. It was an accident. Yes, she is negligent, but putting her in prison isn't going to bring the child back. A sad and terrible situation and I wouldn't want to be the judge in this case. We all make mistakes. This was obviously a huge mistake that this worker will have nightmares about her whole life. That's a mental prison I don't want to be in.

I'm not claiming to know what happened, just pointing out that none of us do and to assume the worst is assinine given the judge's decision. My panties are totally unwadded, yours seem to be soaked in impotent rage piss because you're baselessly assuming this was a malicious act.
