The kid's getting paid because the attorney is going to get paid. And he's a damn good attorney.

Is it 275 million? Nah. But it's probably at least 10, if not a bit higher. Like the other poster said, CNN did NOT want this going to discovery.

He lied about what happened in several TV interviews. He was the one that escalated the situation, but he claimed that the kids were taunting them and made racist comments.

Some of the most egregious examples of emotional distress claims generated around 1 million or less at trial.

Did they involve a major US media corporation with a vested interest to make this story go away prior to discovery?

ETA: And don't bother trying to equate Rolling Stone with CNN. You know they don't even remotely compare.

But the rape story was featured on cnn and every other news media outlet for weeks. RS could reasonably foresee that their false story would get picked up by other major news outlets.

Doesn't really matter that CNN didn't make the initial false story. It's not like the RS story was contained to only RS readers.

I'm not saying the kid didn’t get paid handsomely for his troubles.

I’m saying CNN most likely didn’t settle for 7 or 8 figures above what the kid probably would have gotten at trial.


His economic damages are close to nothing and emotional distress claims without accompanying economic damages are usually not rainmakers.

And based on recent case law, the punitives would have been subject to a reduction if they were anything close to 10+ million.
