Alright OP, I think I've got a handle on your situation. You can afford an attorney but will not spend your money on it. What I am hearing is, that kid is your wife's problem and you really don't give a shite wether she gets the kid or not. You are just saying you want him around bc she wants him around. Your wife smokes weed, her ex did heroin. The kid is 16. That kid is on his own either way.
Just let it go. The judge will know the results at the hearing. Just be prepared to deal with your wife bitching after the hearing.

I had court mandated drug tests during my divorce. I simply refused to take them.

Well as a matter of fact, sans a prenup (and don't even pretend you have a prenup), she owns half of all assets and money (for the most part) that you have acquired after you married her. You don't own anything anymore. You only own half. The other half is hers.

I'm really not trying to be a dick here, but if you can't afford a bottom of the barrel attorney, how do you afford to care for children?

The world is FILLED with out of work lawyers right now.

Also, do you not have ANY lawyer friends that could help you out and at the very least give you a reference to a family attorney for cheap?

Good question. For 16 years he has done very little. He's a millionaire, living in Vegas who recently moved to Austin. Was in People magazine as a "top bachelor" and on various TV shows -- and never made one mention of his son. Now all a sudden he wants custody. Honestly I had no problem with the kid moving to Austin -- I feel there are a helluva lot more opportunities for him out there than there are here. But I don't like the hypocrisy involved in this case -- saying he wants him because of his mom's drug use, yet he uses himself. But, if he passes the hair sample test, all the power to him.

I'm certainly not broke, and as stated prior, I've never touched a drug in my life. I don't smoke and don't drink, either.

This raises more questions. Why isn't she getting child support? I also find it appalling that a court would take a child from a mother for failing a drug test for marijuana only. Not saying that it doesn't happen, but it would seem that she would need to fail for more than just weed to lose custody.

Her son tested positive for weed as well. She does receive child support each month, but the guy has has very little contact with his son for the past 16 years. He never followed his visitation rules established when the kid was a baby, and would basically just come to town to visit his parents once every blue moon and ask to see the kid. There were several circumstances where he was in town and we caught him/saw him and he had made no mention that he was coming to town and made no effort to see his kid. At the original hearing we had to be there at 9 am and didn't get called in until 3. During that time we were sitting just a few feet away, and for those 6 hours and after the whole thing was over he did not say one word to his son, not one.
