You will find out in court if there is a fail. Be suspicious of a fail if the judge orders an impromptu court date to review the results. Sometimes it can take days or weeks for the judge to be notified of the fail, order a retest and be notified again. Then call everyone back in to discuss results. An attorney would really help your wife. Contact your local bar association to see if they can offer help.

Thanks for the serious response. The problem is, they were both given a urine test, and my wife failed hers (positive for marijuana). Therefore my stepson's dad's attorney filed an "ex parte" hearing and was granted immediate custody. The deputies came and got my stepson this afternoon. We assume that his dad passed his urine test, but we have no way to know for certain. Also they both submitted hair samples, which won't be done until the end of this week. His father has a history of heroin addiction and we think he will fail... but once again, we have no way of knowing. There is a hearing scheduled for the 18th of August.

She tried to get legal aid, but since it doesn't involve child support, they don't appoint attorneys.

That's what I told her -- she has no one to blame but herself. But I'd much rather see the kid living here, where he has lived his entire life (16 years) with a pothead, than going to live in Austin (where his dad lives) with a heroin junkie.

I am not a lawyer I just have been on the step parent end of the deal for 8 years. In and out of court first taking domiciliary custody due to moms marijuana use and now having sole custody with the mom only having 4 hours professionally supervised visits a month. That being said I doubt he failed his test if the deputies came. The father may have a history of use, but your wife tested positive recently. Best thing she can do is submit to whatever program the court orders a remain clean, forever. Slowly hoping to gain back some of her custodial time. Now if he ends up with a positive then..well I pray for the kid.

There is no such thing as " I can'y afford an attorney". Rather it is a question of priorities in life and what one is willing to sacrifice for something they represent is important to them. I have had CPA's deliver pizza at night to fight for their kids.....have had clients sell sentimental family heirlooms.....I do not understand anyone who says they cannot afford a lawyer to fight for their kids, yet they maintain their $ 200 cable bill.....their smart phones....and any number of other luxuries.
People define what is important by what they are willing to do to get it. Everyone has different priorities......a persona choice everyone has to make. Some choose to eat ravioli and have a GoPhone for a year or so to make sure they don't get screwed........
