^ Walt O'Reilly, ladies and gents. Now there is a man who knows a thing or two about failing substance tests!

Well, his dad's entire position was that he wants custody because his mom does drugs. So if he fails his test, that would kinda defeat his whole argument, wouldn't you think? And the judge could place the kid w/ me -- I'd pass a drug screen w/ flying colors.

I've never failed a drug test. Just sobriety tests.

Yep, and you turned out fine. The judge should put the kid in your custody until Ronald's better half manages to hit it big at the silver slipper and can hire a lawyer.

Dad likely wouldn't take that specific position unless he knew he could pass drug tests including hair follicle tests. His attorney, if worth a crap, should make sure dad is clean. Hair follicle tests only go back so far for court purposes, like maybe 3-6 months.
Edit: Oh and I haven't heard of judge making an exception because there is a sober step parent in the house. Sorry!

I've never touched a drug in my life. The problem isn't that I don't have the $$; the problem is that I'm not going to spend my hard-earned money on this situation, when she's the one who fricked up. She can use her own money -- of which she has none.
Some marriage.
Think of it this way. You either want her to have custody or you don't. Do what's required to reach that outcome like a man.
a real man would help his wife get custody if she wanted it regardless of what you feel.
But to make it a " she can spend her own money she got herself in this situation" kind of thing is shameful

Also keep in mind that the ex parte is temporary. Mom and dad will still have to hash it out at a later date unless a stipulation is reached. The results of the drug testing will take a big, but not single part in deciding who gets full or primary custody or whatever you guys are fighting for.

If the kid is 16 then why is it even a court matter? The kid is old enough to say who he wants to live with. Is there some reason this kid can't speak up for himself to the judge about his choices and the kind of parents his mother and father are?

You will find out if he failed by whether or not he is in jail. That's how court mandated drug tests work

Well, they're fighting over custody of him. The court ordered it, but how the heck are we supposed to know if he passed or failed?

When we went for the original hearing, he was not allowed in the courtroom, since it was not a trial.
I have the distinct feeling that when we return for the trial on the 18th, that his father will be sure not to bring him, in order to prevent him from speaking.

hair follicle tests for heroin are 1/2" of hair = 1 month of usage.
But all he has to do is show a scrip from a dentist visit where he was prescribed hydrocodone.

Thanks for the serious response. The problem is, they were both given a urine test, and my wife failed hers (positive for marijuana). Therefore my stepson's dad's attorney filed an "ex parte" hearing and was granted immediate custody. The deputies came and got my stepson this afternoon. We assume that his dad passed his urine test, but we have no way to know for certain. Also they both submitted hair samples, which won't be done until the end of this week. His father has a history of heroin addiction and we think he will fail... but once again, we have no way of knowing. There is a hearing scheduled for the 18th of August.
This all sounds backwards. Follicle testing has a look back of at least 90 days. Your wife would have submitted hair to establish the baseline, which if she passed, would infer the monthly testing is accurate if she was found dirty in the future. Knowing she failed urine right off the bat, her follicle testing will be dirty until she stays clean and purges the thc.
As for the results, you don't need an attorney to file a motion to receive them. She's a custodial parent and has the right to petition. Go to the clerk's office and ask for the correct form in this case, do your legwork online to ensure you submit the proper language and pay the nominal fee. They'll set a date.
