Documents obtained by WBRZ News 2 said Givens showed the clerk a badge and suggested the only reason the business was open was because Givens used his position to approve its license.

Givens was given a $1,000 bond after he was booked into the parish prison Thursday.

But how is theft of a pastry a felony? Is it because he used his powerful position as a Baker City Councilman as public intimidation?

I just wasn't aware of a modifier that enhanced a $2 theft to a felony simply because of abuse of office. Pretty nuts. But I get it.

great and all he got arrested, but he doens't belong in any jail.

am i missing where it says he's been removed from office, b/c that's what his punishment should be.

I haven't seen the warrant but I would imagine they charged this as some sort of Strong Arm Robbery as opposed to Misdemeanor Theft. Which would make it a legit felony. Strong Arm Robbery, as opposed to Armed Robbery, is where you use your position or a threat of violence/retaliation to take something from someone. For instance, if I say "give me all the money in the register or I will come back and shoot the place up" or "I am a Councilman and if you report this it will have a negative effect on your business." Absolutely the correct charge. This wasn't merely the shoplifting of a pastry.
